AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS CALLING FOR A SPECIAL ELECTION TO BE HELD ON
SEPTEMBER 14, 2002; DESIGNATING POLLING LOCATIONS AND
NAMING ELECTION OFFICIALS; DETERMINING THAT THE MEETING
AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE
PUBLIC AS REQUIRED BY LAW
WHEREAS, the City Clerk received a petition signed by the required number of
qualified voters of the City of Wichita Falls, Texas to amend the City Charter in
accordance with Chapter 9 of the Local Government Code and the Texas Election
Code; and
WHEREAS, the City Clerk advised the City Council that the next authorized
uniform election date is September 14, 2002.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS THAT:
SECTION 1. It is hereby ordered that a special election is to be held in the City
of Wichita Falls on September 14, 2002 for the purpose of submitting to the qualified
voters of said City the hereafter described proposed charter amendment. Such election
shall be held at the polling places with the election judges and alternate election judges
shown on Exhibit A, attached hereto for all purposes. Rate of pay for the election
workers is set at $8.00/hour.
SECTION 2. There shall be submitted at said special election to be held
September 14, 2002, the following measure as a proposed amendment to the
City Charter of the City of Wichita Falls:
Measure. That Section 154 of the City Charter shall be amended so that such
section shall read as follows:
Section 154. Classifications, Base Salaries, and Seniority Pay for Wichita
Falls Police Officers and Fire Fighters.
Effective October 1, 2002, the classifications in the Wichita Falls Fire Department
will include Fire Fighter, Fire Equipment Operator, Lieutenant, Captain, and Battalion
Chief. The classifications in the Wichita Falls Police Department will include Police
Officer, Sergeant, Lieutenant, and Captain. The Wichita Falls City Council will take all
necessary action by ordinance to create such classifications. The base salary for each
classification in the Wichita Falls Fire Department and the Wichita Falls Police
Department will be set no lower than the median of the base salaries for Fire Fighters
and Police Officers in comparable positions or classifications in the following Texas
,
cities: Abilene, Amarillo, Carrollton, Garland, Grand Prairie, Irving, Laredo, Lubbock,
Mesquite, Midland, Odessa, Plano, and Waco. The new base salary for each
classification will be computed prior to October 1 of each year, and necessary wage
increases will be implemented effective on October 1 each year.
In addition to base salary, each Fire Fighter and Police Officer will receive
seniority pay as currently paid by the City. Each Fire Fighter and Police Officer will
receive at minimum an additional 2% of base salary for each year of his/her first 15
years of service in the Fire Department or Police Department. This seniority payment
will be in addition to longevity payment required by Texas Local Government Code
Section 141.032.
The City shall not reduce or diminish any economic benefit or emolument being
received by Wichita Falls Fire Fighters and Police Officers as a direct or indirect result
of the implementation of this minimum wage requirement. The City Council may
authorize other forms of pay for Fire Fighters and Police Officers in addition to those
required by this Section.
SECTION 3. The proposed measure to amend the Charter of the City of Wichita
Falls as proposed in Section 2 of this ordinance shall be submitted to the qualified
voters at a special election on September 14, 2002, on the ballot and in the form of the
following proposition. The words "For" and "Against" shall be printed to the left of the
proposition on the ballot.
Proposition. Shall Section 154 of the City Charter be amended to require
certain job classifications in the Fire and Police Departments with the minimum base
pay for such classifications determined each year according to the median base pay for
comparable classifications in the cities of Abilene, Amarillo, Carrollton, Garland, Grand
Prairie, Irving, Laredo, Lubbock, Mesquite, Midland, Odessa, Plano, and Waco, plus an
additional 2% of such base salary for each year of the employee's first 15 years of
service in the Fire Department or Police Department, plus such additional longevity
payments required by the Texas Local Government Code Section 141.032?
SECTION 4. It is officially found and determined that the meeting at which this
ordinance was passed was open to the public as required by law.
