Res 224-84 11/20/1984RESOLUTION NO. 224-84 CERTIFICATE FOR RESOLUTION THE STATE OF TEXAS COUNTY OF WICHITA CITY OF WICHITA FALLS We, the undersigned officers of said City, hereby certify as follows: 1. The Board of Aldermen of said City convened in REGULAR MEETING ON THE 20th DAY OF NOVEMBER, 1984 , at the City Hall, and the roll was called of the duly constituted officers and members of said Board of Aldermen, to-wit: Gary Cook, Mayor Thomas Swift Charles Thomas Charles Harper Craig A. Wilson Bill Palmer James Welburn Wilma J. Thomas, City Clerk and all of said persons were present, except the following absentees: Charles Harper thus con- stituting a quorum. Whereupon, among other business, the followin g was transacted at said Meeting: a written RESOLUTION DIRECTING PUBLICATION OF NOTICE OF INTENTION TO ISSUE WATERWORKS AND SEWER SYSTEM REVENUE BONDS was duly introduced for the consideration of said Board of Aldermen and read in full. It was then duly moved and seconded that said Resolution be adopted; and, after due discussion, said motion carrying with it the adoption of said Resolution, prevailed and carried by the following vote: AYES: All members of said Board of Aldermen shown present above voted "Aye" . NOES: None. 2. That a true, full and correct copy of the aforesaid Resolution adopted at the Meeting described in the above and foregoing paragraph is attached to and follows this Certifi- cate; that said Resolution has been duly recorded in said Board of Aldermen' s minutes of said Meeting; that the above and foregoing paragraph is a true, full and correct excerpt from said Board of Aldermen' s minutes of said Meeting pertaining to the adoption of said Resolution; that the persons named in the above and foregoing paragraph are the duly chosen, qualified and acting officers and members of said Board of Aldermen as indicated therein; that each of the officers and members of said Board of Aldermen was duly and sufficiently notified officially and personally, in advance, of the time, place and purpose of the aforesaid Meeting, and that said Resolution would be introduced and considered for adoption at said Meeting, and each of said officers and members consented, in advance, to the holding of said Meeting for such purpose, and that said Meeting was open to the public and public notice of the time, place and purpose of said meeting was given, all as required by Vernon' s Ann. Civ. St. Article 6252-17. 3. That the Mayor of said City has approved and hereby approves the aforesaid Resolution; that the Mayor and the City Clerk of said City have duly signed said Resolution; and that the Mayor and the City Clerk of said City hereby declare that their signing of this Certificate shall constitute the signing of the attached and following copy of said Resolution for all purposes. SIGNED AND SEALED the 20th day of Novem-* , 1984 City Clerk for SEAL) RESOLUTION NO. 224-84 RESOLUTION DIRECTING THE PUBLICATION OF NOTICE OF INTENTION TO ISSUE CITY OF WICHITA FALLS, TEXAS WATERWORKS AND SEWER SYSTEM REFUNDING REVENUE BONDS, SERIES 1984 AMOUNT OF $20,000, 000 THE STATE OF TEXAS COUNTY OF WICHITA CITY OF WICHITA FALLS WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas, deems it necessary and advisable that the bonds hereinafter described be authorized, issued, sold, and delivered. THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: That the foregoing notice shall be published in a newspaper published in, and having general circulation in, the City of Wichita Falls, Texas, on the same day of each of two consecutive weeks, with the date of the first publication to be at least two weeks prior to the date upon which the Board of Aldermen intends to pass the Ordinance described in the following notice: NOTICE OF INTENTION TO ISSUE CITY OF WICHITA FALLS, TEXAS WATERWORKS AND SEWER SYSTEM REFUNDING REVENUE BONDS, SERIES 1984, IN THE PRINCIPAL AMOUNT OF $20, 000,000 Notice is hereby given, in accordance with Article 2368a, Vernon' s Annotated Texas Civil Statutes, that the Board of Aldermen of the City of Wichita Falls, Texas, intends to pass, at a Special Meeting to be held at 10:00 o'clock a .m. , on December 11 , 1984, at the City Hall, an Ordinance authorizing the issuance, sale, and delivery of an issue of negotiable bonds to be designated as City of Wichita Falls, Texas Waterworks and Sewer System Refunding Revenue Bonds, Series 1984" , in the maximum principal amount of $20, 000,000, to be payable from and secured by first lien on and pledge of the Net Revenues of the City' s Waterworks and Sewer System, all as will be defined and provided in the aforesaid Ordinance. Said bonds will bear interest from their date at maximum rates not to exceed fifteen percentum, will be scheduled to mature serially within a maximum of not to exceed thirty years from their date, and will be subject to redemption prior to maturity, and will have such other and further characteristics, as will be provided in the aforesaid Ordinance. Said bonds will be authorized, issued, sold and delivered pursuant to Articles 717K, 1111, 1112, 1113, and 1114, Vernon's Annotated Texas Civil Statutes, and other applicable laws, for the purpose of providing money for improvements and extensions of the combined Waterworks and Sewer System of the City of Wichita Falls and for the purpose of refunding the City's outstanding Revenue Bonds.
