RESOLUTION AGREEING TO ACCEPT REFUSE
FROM THE CITY OF HOLLIDAY, TEXAS
WHEREAS, the City of Wichita Falls has established terms,
requirements and conditions for accepting refuse at the City Sanitary
Landfill; and,
WHEREAS, the City of Holliday, Texas, wishes to use the
Wichita FallsSanitaryCityofWichitaFallsyiLandfilllocatedWestof
and identified by Permit No. 1428; and,
WHEREAS, the City of Holliday, Texas, agrees to comply with
all the requirements of Chapter 17 of the Code of Ordinances of the
City of Wichita Falls; and,
WHEREAS, the City of Holliday, Texas, has requested that the
City of Wichita Falls supply eighteen months advanced notice should the
City of Wichita Falls unilaterally decide to prohibit the City of
Holliday from utilizing the Wichita Falls Sanitary Landfill.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The City of Wichita Falls agrees to provide advance notice
of eighteen months to the City of Holliday, Texas, should the City of
Wichita Falls unilaterally decide to cease accepting refuse from the
City of Holliday, Texas. It is understood that this eighteen months
notice will only be required if the City of Holliday, Texas, is adhering
to all the requirements of Chapter 17 of the Code of Ordinances of the
City of Wichita Falls. Nothing in this resolution will be construed to
obligate the City of Wichita Falls to accept refuse from the City of
Holliday, Texas, should a natural disaster or other unforeseen circumstances
cause the current landfill under Permit No. 1428 to become prematurely full.
