ORDINANCE AMENDING SECTION 32-1 OF THE CODE OF
ORDINANCES TO ESTABLISH A LATE PAYMENT FEE FOR UTILITY
BILLING; FINDING AND DETERMINING THAT THE MEETING AT
WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC
AS REQUIRED BY LAW.
WHEREAS, the City bills for water, sewer, sanitation and storm water services
on a monthly basis; and
WHEREAS, no penalty is assessed to customers who fail to pay their utility bill
by the due date; and
WHEREAS, approximately 15% of the customer base receive two-month bills
that contain delinquent charges; and
WHEREAS, it is anticipated that a late payment fee will reduce the number of
past due accounts and assist the City in collection of service charges due for water,
sewer, sanitation and storm water services.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Chapter 32-1 of the Code of Ordinances is hereby amended in its
entirety as follows:
'Sec. 32-1. Billing, late payment fee, disconnecting and reconnecting fees.
All services for water, sewer, sanitation, and storm water accounts shall be billed
together on a monthly basis.
All water, sewer, sanitation, and storm water accounts shall be payable monthly and
shall carry a due date of approximately fifteen (15) days after the billing date. The bill
shall include a notice which will state that if payment is not received by the due date,
then a 5% late payment fee will be assessed on the amount due. If such bill has not
been paid by the due date, then a late payment fee of 5% will be assessed to the
balance of the account. If such bill has not been paid by the billing date of the
succeeding month's bill, then the succeeding month's bill will include a delinquent notice
which will state that the customer's service will be discontinued without further notice
unless payment is made on or before the due date and a service fee of fifteen dollars
($15.00) must be paid before service will be restored. The delinquent notice will also
include a statement that a 5% late payment fee will be assessed on the amount due if
payment is not received by the due date. If the full amount has not been paid on or
before the due date of the second month's bill or satisfactory arrangements for paying
the bill have not been made, the water, sewer and sanitation services will be
discontinued, and a service fee of fifteen dollars $15.00 and a late payment fee of 5%
will be charged to the account. Discontinued service will be restored with full payment
of the bill including any late fees and the fifteen dollar service fee.'
SECTION 2. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
