Res 228-84 11/20/1984RESOLUTION NO. oUD,47 RESOLUTION DECLARING CERTAIN LAND AND STRUCTURE OWNED BY THE CITY IN BLOCK 177, ORIGINAL TOWN, TO BE EXCESS AND SURPLUS AND DIRECTING THAT SAME BE ADVERTISED FOR SALE ON SEALED BIDS WHEREAS, heretofore the City of Wichita Falls has acquired the west thirty (30) feet of Lot 1 , the west thirty (30) feet of the north forty (40) feet of Lot 2, the east fifty (50) feet of Lot 14 and east fifty (50) feet of north forty (40) feet of Lot 14 all being in Block 177, Original Town of Wichita Falls, and the Route Building located thereon for the Depot Square Project, and WHEREAS, although the acquisition of such land and structure by the City was made in good faith for the development of the Depot Square Project, it is now found that it would be in the public interest for the project to be developed by private interests. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS THAT: SECTION 1 . The necessity of acquiring the above land and structure and the public purpose on which it was based, no longer exist. SECTION 2. The above described land and structure owned by the City of Wichita Falls in said Block 177 are declared to be excess and surplus and should be sold by the City, subject to the provisions contained in Section 3. SECTION 3. The City Manager is hereby authorized and directed to publish in a newspaper of general circulation in Wichita County, Texas a notice that such land and structure are to be offered for sale to the general public on sealed bid in accordance with Article 5421c-12, Revised Civil Statutes of Texas; notice shall be so given on two separate occasions, and no sale shall be held less than 14 days after the last notice. The sale shall be made subject to the following qualifications: A. A minimum bid of $25,250.00 will be required. 2 B. Plans for use of land and structure as retail , office, restaurant or other compatible uses must accompany the bid. Such plans must comply with all applicable City codes and ordinances. C. Plans for alteration of the Route Building's exterior must be approved by the Landmark Commission of the City of Wichita Falls.
