RESOLUTION APPROVING THE PROPOSED COST SHARING
BETWEEN THE FEDERAL GOVERNMENT AND THE CITY OF
WICHITA FALLS , TEXAS RELATING TO THE CONSTRUCTION
OF THE LAKE WICHITA DAM AND THE CHANNELIZATION
OF HOLLIDAY CREEK.
WHEREAS, the Army Corps of Engineers has presented a
plan to reduce flooding damage on Holliday Creek and to
make the Lake Wichita Dam safe;
WHEREAS, the plan is outlined in a communication from
the Assistant Secretary of the Army (Civil Works) and is
entitled Lake Wichita, Holliday Creek, Texas ;
WHEREAS, the City Council deems it desirable to pro-
ceed with the construction as outlined by the Army Corps
of Engineers document;
WHEREAS, the City Council concurs with the cost
distribution as outlined in revision "A" to a letter dated
September 24, 1984 to the District Commander of the Tulsa
District of the Corps of Engineers.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF WICHITA FALLS, TEXAS, THAT:
The City Council concurs with the funding distribution
and agrees to the terms and conditions contained in revision
A" to a letter dated September 24 , 1984 to Colonel Franklin
T. Tilton, District Commander of the Tulsa District of the
Corps of Engineers and signed by the Mayor of the City of
Wichita Falls.

Dear Colonel Tilton:
Reference is made to your letter of August 21 , 1984 ,
and to our discussions regarding construction of the Lake
Wichita, Holliday Creek, Texas project. This letter
constitutes an expression of intent by the City of Wichita
Falls, Texas, to cooperate with the Federal Government in
initiating construction of the Lake Wichita, Holliday Creek,
Texas project in Government Fiscal Year 1986 .
To facilitate construction of the Lake Wichita, HollidayCreek, Texas project, the City of Wichita Falls, Texas will
provide all lands, easements, right-of-ways and relocations,
with the exception of railroads, necessary for construction
of the project, plus the cost of making the existing Lake
Wichita Dam safe, during the period of project construction
as required in communication from the Assistant Secretary of
the Army (Civil Works) entitled Lake Wichita, Holliday Creek,
Texas. In addition, the City of Wichita Falls , Texas will
provide such funds as are necessary to meet the following
non-federal requirements for construction during the term
of construction. This will amount to 35% of flood damage
reduction costs, which is applicable to the Lake Wichita,
Holliday Creek, Texas project.
It is understood that the providing of all lands, ease-
ments, right-of-ways , and relocations, with the exception
of railroads, necessary for construction of the project,
plus the cost of making the existing Lake Wichita Dam safe,
is a non-federal responsibility and that the City of Wichita
Falls , Texas will bear the full cost thereof, regardless of
the 35% cost sharing percentage specified above. It is also
understood that the City of Wichita Falls, Texas will bear the
cost of operating and maintaining the project upon completion
of construction in accordance with regulations prescribed by
the Secretary of the Army.

The project to be constructed is that generally described
in a communication from the Assistant Secretary of the Army .Civil Works) as referred to the Committee on Public Works and
Transportation on May 10, 1984 ; approved by the Assistant
Secretary of Army on April 25, 1984 ; and as approved by theOfficeofManagementandBudgetonMarch5, 1984. Attached
as exhibit "A" , is a schedule of projected federal and non-
federal expenditures through fiscal year 1989. This schedule
is based on a $30, 0.0,.000 extimate of total project costs,
which includes an allowance for inflation through the construc-
tion period. It is understood that estimates of costs are
preliminary and that final costs will depend upon the actual
costs of construction, however, if prior to construction more
detailed studies indicate a substantial increase in cost, a
new agreement shall be negotiated.
The City of Wichita Falls, Texas is the agency empowered
by law to provide the non-federal cooperation required for the
Lake Wichita, Holliday Creek, Texas project, and prior to con-
struction will enter into a binding written agreement with
appropriate representatives of the Corps of Engineers which
addresses project construction and satisfies the requirements
of Section 221 of Public Law 91-611.
It is further understood that if the City of Wichita Falls,
Texas cost sharing proposal is acceptable to the Assistant
Secretary of Army (Civil Works) , he will recommend to the Office
of Management and Budget that an appropriate request for funds
to support the Lake Wichita, Holliday Creek, Texas construction
be included in the President' s budget for Fiscal Year 1986. As
previously recognized, if legislation is enacted which changes
cost sharing for the Lake Wichita, Holliday Creek, Texas project,
such cost sharing provisions will supercede this financial
agreement.
