RESOLUTION /Y2 4-
RESOLUTION APPROVING THE APPRAISALS OF
PROPERTIES FOR EASEMENTS TO ACCOMODATE
WATER AND SEWER MAINS AND AUTHORIZING
THE PURCHASE OR CONDEMNATION OF SAME.
WHEREAS, it is necessary to acquire easements across
the properties herein described for construction of water and
sewer mains, and;
WHEREAS, such properties have been appraised by an
appraiser employed by the City of Wichita Falls and the amount
of the value as determined from the appraisal has been studied
by the City Council , and copies are now in the possession of the
Director of Public Works.
NOW THEREFORE, be it resolved by the City Council of the
City of Wichita Falls, Texas, that:
Section No. 1 The description of the easements to be purchased
are as follows:
TRACT #1: A 20 foot wide easement out of Lot 2-A, Block 3,
Burlington-Call Field Industrial Addition, an addition to the
City of Wichita Falls as recorded in Volume 22, Page 291 of the
Wichita County Plat Records, said lot also being out of the Annie
E. Cummings Survey, Abstract No.610;
Beginning at at a point which bears South 65 degrees 17
minutes West 494 feet from the northeast corner of said lot 2-A,
Block 3, said beginning point being in the South right-of-way
line of Kell Boulevard; Thence South 00 degrees 37 minutes West
69.46 feet to a point for corner;
Thence North 89 degrees 23 minutes West 20.00 feet to a
point in the East right-of-way line of Lawrence Road;
Thence North 00 degrees 37 minutes East 45.00 feet along
said east right-of-way line of Lawrence Road to a point;
Thence in an easterly direction along the south right-of-way
line of Kell Boulvard as follows: North 32 degrees 55 minutes
East 25.30 feet; North 65 degrees 17 minutes East 7. 17 feet to
the place of beginning. Containing 1193 square feet more or less.
TRACT #2: A 10 foot wide water line easement across a tract out
of the Day Land and Cattle Company Survey, Abtract No. 610 and
also being a part of Block 164, Highland Addition, an addition to
the City of Wichita Falls, Wichita County, Texas, said tract also
being described in a deed from S. J. Knuckley, et ux, to H. M.
Malone recorded in Volume 1203, Page 201 of the Wichita County
Deed Records, said easement being adjacent and parallel to the
south right-of-way line of Kell Boulevard as described in a
judgement recorded in Volume 1308, Page 345, and said easement
being more particularly described by metes and bounds as follows:
Beginning at the intersection of the south right-of-way line
of Kell Boulevard as described in Volume 1308, Page 345 and the
west line of said Malone tract;
Thence South 01 degrees 08 minutes West 11 .07 feet along the
east right-of-way line of Wenonah Street to a point;
Thence North 65 degrees 44 minutes East 100.00 feet to a
point;
Thence North 01 degrees 08 minutes East 11.07 feet to a
point in the south right-of-way line of Kell Boulevard;
Thence along the south right-of-way line of Kell Boulevard
South 65 degrees 44 minutes West 100.00 feet to the place of
beginning. Containing 1000 square feet more or less.
TRACT#3: A 20 foot wide easement across Lot 1 , Block 1 , St. Paul
Lutheran School Subdivision, an addition to the City of Wichita
Falls, Wichita County,Texas as recorded in Volume 24, Page 393 of
the Wichita County Plat Records, said Lot 1 also being out of the
S.P.R.R. Co. Survey No. 1 , A 281 :
Beginning at a point in the south line of said Lot 1 , Block
1 , said point bears West 672.00 feet from the southeast corner of
said Lot 1 , Block 1 , said point to be on the centerline of a 20
foot wide easement;
Thence North 143.41 feet along the centerline of the 20 foot
wide easement to a point in the south right-of-way line of Kell
Boulevard for the end of this easement.
Section No. 2 The value of each easement is hereby approved and
the City Manager is authorized to purchase the herein described
easements in the name of the City of Wichita Falls. The
authorized price to be paid for such tract is the value as
determined from the appraisal made by the real estate appraiser
employed by the City of Wichita Falls.
Section No. 3 In the event the City Manager is unable to
purchase any of the easements for such approved value, he is
hereby authorized and directed to cause to be instituted,
condemnation proceedings to obtain any of the easements in the
name of the City of Wichita Falls.
