RESOLUTION TO ACCEPT CONSTRUCTION OF
SLUDGE DISPOSAL FACILITY AND AUTHORIZE
FINAL PAYMENT TO BOWLES CONSTRUCTION
COMPANY
WHEREAS, the City of Wichita Falls contracted with the
Bowles Construction Company for construction of a sludge disposal
facility at the Wastewater Treatment Plant;
WHEREAS, the work has been completed and city personnel have
determined the work is acceptable;
WHEREAS, the contractor has been previously paid $156,408.75
of the total contract price of $176,287.50 and has now submitted a final
payment request for $19,878.75;
WHEREAS, the original completion date for the work as May 18,
1984, and was formally extended to June 18, 1984;
WHEREAS, the city accepted the work as substantially complete
and began using the project for its designed purpose on July 17, 1984,
making the project 29 days late (June 19, 1984 to July 17, 1984); and
WHEREAS, the contract provides for liquidated damages of $50.00
per day for each day the construction time exceeded the contract time.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
The construction work performed on the sludge disposal facility
is accepted. The contractor is to be assessed $1,450.00 in liquidated
damages as provided in the contract and the City Manager is authorized
to make a final payment of $18,428.75 to the Bowles Construction Company.
PASSED AND APPROVED THIS THE 18TH DAY OF SEPTEMBER, 1984.
