RESOLUTION TO APPROVE CHANGE ORDER #2 AND
TO ACCEPT CONSTRUCTION WORK ON NORTH BEVERLY
PUMP STATION
WHEREAS, the City of Wichita Falls contracted with the Bowles
Construction Company for certain modifications to the North Beverly Pump
Station;
WHEREAS, it was necessary to do some painting which was not in
the original contract and the Council has examined Change Order #2 for this
added work;
WHEREAS, the construction contract was not completed in the
prescribed construction period ending July 21, 1984, and the contract stipulates
liquidated damages will be assessed;
WHEREAS, the work was substantially complete and being used for
its intended purpose on July 31, 1984; and
WHEREAS, the work has been examined and found fully complete and
acceptable as of August 24, 1984.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:
The construction work performed at the North Beverly Pump Station
is hereby accepted, including Change Order #2. Liquidated damages of $1,000.00
will be assessed from July 22, 1984, the first full day after the stipulated
completion date, to July 31, 1984, the day the station was first used for its
intended purpose.
The City Manager is authorized to sign Change Order #2 and to make
a final payment of $43,124.47 to Bowles Construction Company.
