RESOLUTION ACCEPTING CONSTRUCTION OF IRRIGATION
LAGOON SUPPLY LINE AND PUMP STATION IN WEEKS
PARK BY BOWLES CONSTRUCTION COMPANY, INC.
WHEREAS, the City of Wichita Falls and Bowles Construction
Company, Inc. , as Contractor, entered into a contract dated
March 15 , 1984, whereby Contractor agreed to construct an irriga-
tion lagoon supply line and pump station in Weeks Park for the
golf course; and,
WHEREAS, the construction of such improvements has been
completed in accordance with the plans and specifications; and,
WHEREAS, the total contract price was $84 , 301 .50, of which
75 ,871.35 has been paid to the Contractor; in addition, liquidated
damages in the amount of $50 . 00 per day for 17 days, totaling
850 . 00 , have been assessed against the Contractor for excessive
time, which leaves a balance due of $7, 580 . 15 .
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS , TEXAS , THAT:
The construction of such improvements is hereby accepted by
the City, and the City Manager is authorized to pay to the Contractor
the balance due under said contract as set out above.
