ORDINANCE CLOSING, ABANDONING, AND VACATING A 15-
FOOT BY 250-FOOT SECTION OF AN ALLEY ADJACENT TO
THE SOUTHERN PORTIONS OF LOTS 8, 9, 10, 11, AND 12 OUT
OF BLOCK 4, COUNTY CLUB ADDITION, WICHITA FALLS,
WICHITA COUNTY, TEXAS, ALSO KNOWN AS 1601, 1603, 1605,
1607, AND 1609 32ND STREET; FINDING AND DETERMINING
THAT THE MEETING AT WHICH THIS ORDINANCE WAS
PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, W.V. Housing, Ltd. has requested closing, abandoning, and
vacating the portion of the alley as described that is adjacent to the property
location of the proposed project; and
WHEREAS, all affected City departments and affected utility companies
have been contacted and have approved this closure; and
WHEREAS, the City Council of the City of Wichita Falls, Texas deems it
advisable and in the public interest to close, vacate and abandon that portion of
the alley hereinafter described subject to the filing of a final re-plat within six
months of the date of approval of this ordinance and with the approval and
passing of the ordinance to rezone the property adjoining the alley to multifamily
and amendment of the land use plan.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. That 15-foot wide by 250-foot wide portion of the alley
located behind and on the south side of 1601, 1603, 1605, 1607, and 1609 32"d
also known as Lots 8, 9, 10, 11, and 12 out of Block 4, Country Club Addition,
Wichita Falls, Wichita County, Texas, is hereby closed, abandoned and vacated.
Said alley is shown as indicated on the attached map, incorporated in this
ordinance as Attachment "A."
SECTION 2. That in consideration of the receipt of One Thousand Eight
Hundred Seventy Five Dollars and No/I00 ($1,875.00) for the fair market value of
the property and Two Hundred Dollars and No/I00 ($200.00) for the appraisal
fee, this ordinance shall authorize the Mayor to execute a quit claim deed for the
City's interest in the property. The deed shall be executed conditioned upon the
property owners filing an approved re-plat of the property in the records of the
Wichita County Clerk. This filing shall occur within six months of the date of
approval of this ordinance. This ordinance shall be void and have no effect if
said re-plat is not approved and filed within the stipulated time period or if the
ordinance requesting the property to be rezoned multifamily is not passed.
SECTION 3. It is hereby officially found and determined that the
meeting at which this ordinance was passed was open to the public as required
by law.
