RESOLUTION APPROVING AND AUTHORIZING SALE OF TREATED
CITY WATER TO SERVE MASKAT TEMPLE 'S 30 ACRE TRACT OF
LAND LOCATED OUTSIDE THE CITY LIMITS AT THE INTER-
SECTION OF HATTON AND MCKINNEY ROADS.
WHEREAS, Maskat Temple owns a 30 acre tract of land located
outside the City limits at the intersection of Hatton and McKinney
Roads, on which they plan to build new facilities, including a new
temple and an arena for horse shows and other events; and,
WHEREAS, Maskat Temple has requested authority to connect such
property with the City' s water supply system, and to purchase
treated water to serve such property; and,
WHEREAS, the City Council finds that the circumstances involved
in this request are unusual, and that it would be in the public
interest to grant such request, subject to certain conditions.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
Notwithstanding the provisions of Resolution No. 1057 and other
policies concerning sale of City water outside the City limits, such
request is approved, and Maskat Temple is authorized to connect the
above property to the City' s water supply system, and to purchase
treated water to serve such property, on the basis of the following
conditions:
1. All such water shall be used for non-commercial use only,
by Maskat Temple, which is a non-profit charitable organization.
2. This right to purchase water by Maskat Temple shall be
non-assignable.
3 . Maskat Temple shall, at their sole expense , construct
the water line necessary to serve this property, which line shall be
constructed in accordance with all City specifications .
4 . All construction of buildings and other structures
hereinafter commenced on such tract of land shall be in accordance
with all City codes and ordinances .
5 . As long as this property remains outside the City limits,
the rates to be charged for water and related services shall be
twice the rates charged for a similar service connection within
the City limits.
6 . At such time as this property is annexed by the City,
Maskat Temple shall pay pro rata charges for the extension of all
utility service, such pro rata charges to be computed in accordance
with the then current ordinance.
