RESOLUTION ACCEPTING CONSTRUCTION AND AUTHORIZING
FINAL PAYMENT TO THE CONTRACTOR FOR THE 1980-82
CAPITAL IMPROVEMENTS PROGRAM, PROJECT 82-1 .
WHEREAS, the City of Wichita Falls and Zack Burkett
Company entered into a contract dated September 7, 1982 ,
for the construction of the 1980-82 Capital Improvements
Program, Project 82-1 ; and,
WHEREAS, such project has been completed in accordance
with the plans and specifications ; and,
WHEREAS , such contract was a unit price contract, and
the estimated cost based on estimated quantities was
1 ,075,630. 15; however, on the basis of the actual quantities
used in the construction, the total contract price is
1 ,071 ,444. 32, of which $1 ,016, 762.37 has been paid to
the contractor, leaving a balance due of $54,681 . 95.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF WICHITA FALLS , TEXAS, THAT:
The construction of such project is accepted by the City
of Wichita Falls, and the City Manager is authorized and
directed to pay to the contractor the amount due as set out
above.
