A RESOLUTION DESIGNATING MIDTOWN AREA NO. 2 AS BLIGHTED AND
REQUESTING THE TEXAS ECONOMIC DEVELOPMENT COMMISSION TO
ACCEPT THE BLIGHTED AREA AS ELIGIBLE FOR COMMERCIAL PROJECTS
WHEREAS, an area hereafter called the Midtown Blighted Area No. 2 is
located within the City of Wichita Falls, Texas; and,
WHEREAS, the proposed Midtown Area No. 2 is described as follows:
Beginning at the intersection of the west right-of-way line of US
287 and the south bank of the Big Wichita River;
Thence southerly along the east property line of Riverside Cemetery
to the south right-of-way line of 5th Street;
Thence east to the east right-of-way line of Brook Ave. ;
Thence north along an extension of the east right-of-way line of
Brook Avenue to the north and east right-of-way line of US 287;
Thence northwest along the right-of-way line to the south bank of
the Big Wichita River;
Thence along the south bank of the Big Wichita River to the place
of beginning; and,
WHEREAS, the map of the proposed Midtown Blighted Area No. 2 is incor-
porated as part of this resolution; and,
WHEREAS, the City Council finds designation of the Midtown Blighted Area
No. 2 is justified for the following reasons:
1. The Midtown Blighted Area No. 2 is located adjacent to two proposed
or designated Blighted Areas. The Midtown Blighted Area No. 2 has similar devel-
opment characteristics.
2. Approximately 25% of the residential structures in the area are severely
dilapidated or deteriorated, and approximately 30% of the remaining homes show
evidence of deterioration or substandard condition.
3. Commercial structures in the area are generally antiquated and
substandard.
4. The failure of vacant land in the area to develop and the lack of
modernization and redevelopment near the urban core impairs the sound growth and
development of the city; and,
WHEREAS, the City Council finds that the Midtown Area No. 2 contains a
substantial number of substandard, slum, deteriorated, or deteriorating structures,
such conditions substantially impairing the sound growth of the city and constituting
economic and social liabilities; and,
WHEREAS, objectives of the City of Wichita Falls include the infill of
vacant land, encouraging redevelopment of the urban core, encouraging development of

the Wichita River Greenbelt, and provision of an adequate supply of employment
opportunities; and,
WHEREAS, the availability of financing of projects for commercial uses
under the Development Corporation Act of 1979 (Article 5190.6 Vernon's Texas Civil
Statutes, as amended) will contribute significantly to the alleviation of the
blighted conditions.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS THAT:
SECTION 1. The Midtown Area No. 2 is hereby designated as a blighted
area by the City of Wichita Falls and that the Texas Economic Development Commission
is requested to accept the blighted area for commercial projects in accordance with
the provisions of the Development Corporation Act of 1979 as amended and the admin-
istrative rules and regulations adopted under its authority.
SECTION 2. The City Council shall review all project descriptions for
approval. Specific projects for commercial uses shall be reviewed in order to
determine whether such projects are consistent with the City's objectives and
guidelines for development of the Blighted Area.
A. Desired projects are those which will result in significantly
enhanced employment opportunities for local residents and which will strengthen
the Wichita River Greenbelt project.
B. The project should avoid displacement of area residents. When
displacement is unavoidable, a reasonable effort should be made to assist the
displaced persons and mitigate any hardships involved.
C. The project should not have a significant negative impact on
existing residential areas. Development near residential areas should include
buffering and screening. No project shall be approved if the parcel of land on
which the project is located is limited by deed restrictions to residential
purposes. No project shall be approved if the proposed use would constitute a
violation of the deed restriction placed upon said parcel.
D. The project should comply with the Wichita Falls Flood Plain
Ordinance No. 3282. Projects with larger amounts of runoff should use storm water
detention or other methods to reduce peak flood volumes.
