RESOLUTION GRANTING AN EASEMENT TO TEXAS ELECTRIC SERVICE
COMPANY AND AUTHORIZING THE CITY MANAGER TO EXECUTE SAME
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS,
FALLS, TEXAS, THAT:
That certain distribution easement and right-of-way, a copy of which
is attached hereto, from the City of Wichita Falls to Texas Electric Service
Company, is hereby approved, and the City manager is authorized to execute
the same for the City of Wichita Falls.
PASSED AND APPROVED this the 3rd day of April, 1984.

THAT, the City of Wichita Falls
for and in consideration of the sum of One
1.00 Dollars, cash to us in hand paid by Texas Electric
Service Company, receipt of which is hereby acknowledged, and in further consideration of
the benefits to be derived by _ said company on account of the construction, operation
and maintenance by Texas Electric Service Company of said electric line through its
premises hereinafter described, do hereby give and grant to Texas Electric Service Company
the right to construct, service and perpetually maintain electric line, together with all
necessary appurtenances and connections thereto, in, upon and across that certain lot, tract
or parcel of land situated in Wichita County, Texas, described as follows: to-wit:
BEGINNING at the Southeast corner of Lot 4, Block 2, Midwestern
Park Subdivision, Unit 2, an addition to the City of Wichita Falls as
recorded in Volume 23, Pages 213 and 214, Wichita County Plat Records;
THENCE S 84° 12' E a distance of 7.5 feet; THENCE N 05° 48' E a
distance of 60.0 feet; THENCE N 84° 12' W a distance of 7.5 feet to
a point in the East line of said Lot 4; THENCE S 05° 48' W with said
lot line a distance of 60.0 feet to the PLACE OF BEGINNING.
TO HAVE AND TO HOLD said easement perpetually to Texas Electric Service Company, a
corporation, its successors and assigns, together with the right and privilege at any and all
times to enter into said premises, or part thereof, for purposes of constructing, servicing,
maintaining and operating said electric line, appurtenances and connections; all upon the
condition that the Texas Electric Service Company, after doing any work in connection with
the construction, maintenance and opertion of said sewer line, restore the ground as nearly
as possible to the condition in which it was found before such work was undertaken. The City
of Wichita Falls does not warrant said easement herein granted.
