Res 019-84 2/7/1984Ir RESOLUTION NO. //-_ d RESOLUTION APPROVING CHANGES IN THE NON-ANNEXATION CONTRACT WITH PPG INDUSTRIES, INC. , APPROVED BY RESOLUTION NO. 226-83 . WHEREAS , by Resolution No. 226-83 , the City Council of the City of Wichita Falls approved a non-annexation contract with PPG Industries, Inc. , whereby the City guaranteed the continuation of the extraterritorial status of the Bacon Switch Addition, on which their plant is located; and, WHEREAS, PPG Industries, Inc. desires to make certain changes and additions to such contract, and the City Council has no objection to such changes and additions. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS , THAT: The non-annexation contract with PPG Industries, Inc. , as approved by Resolution No. 226-83 , may be changed as follows: 1 . The following clause shall be added to the end of Paragraph 6, "throughout the term of this contract . " 2. The following sentence shall be added to the end of subparagraph b . of Paragraph 8 , to-wit: If any buildings or improvements are demolished or removed from the property, their appraised value shall be deducted from the appraisal of the buildings and improvements under this contract. " 3 . The following sentence shall be added to the end of subparagraph c . of Paragraph 8 , to-wit: If any machinery, equipment or other personal property is destroyed or removed from the property, their appraised value shall be deducted from the appraisal of the machinery, equipment and other personal property under this contract. " 4 . A new numbered paragraph shall be added to the contract, to read as follows : The benefits of this contract shall extend to any PPG affiliate, for example, a corporation, partnership or other business enterprise in which PPG owns or controls at least 50% of the stock, which may become an owner of this property. " 5. A new numbered paragraph shall be added to this contract, to read as follows: This contract shall inure to the benefit of and be binding upon City and PPG, their successors and assigns .
