RESOLUTION NO. 18-84
RESOLUTION APPROVING A CHANGE IN THE NON-ANNEXATION
CONTRACT WITH CERTAIN-TEED CORPORATION, APPROVED BY
RESOLUTION NO. 227-83 .
WHEREAS, by Resolution No. 227-83 , the City Council of the
City of Wichita Falls approved a non-annexation contract with
Certain-Teed Corporation, whereby City guaranteed the continuation
of the extraterritorial status of Lot 1 of Certain-Teed Products
Addition; and,
WHEREAS, Certain-Teed Corporation desires to add certain language
to the contract, and the City Council has no objection to such
additions.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS , TEXAS, THAT:
The non-annexation contract with Certain-Teed Corporation, as
approved by Resolution No. 227-83 , may be changed by adding the
following language:
1. The following sentence shall be added to the end of
sub-paragraph b. of paragraph 8 , to-wit:
The appraisal of all buildings and other improvements which
are subsequently razed or removed from the premises shall be deleted
from the appraisal of the buildings and other improvements under
this contract. "
2. The following sentence shall be added to the end of sub-
paragraph c . of paragraph 8 , to-wit:
The appraised value of all machinery, equipment or other
personal property which is subsequently scrapped or removed from the
premises shall be deleted from the appraised value of the machinery,
equipment and other personal property under this contract."
The City Manager is authorized to execute such contract with
these changes.
PASSED AND APPROVED this the 7th day of February, 1984 .
