RESOLUTION TO APPROVE A SANITARY WASTE
WATER DISPOSAL AND TREATMENT CONTRACT
WITH LAKESIDE CITY
WHEREAS, Lakeside City has applied to the City of Wichita Falls
for disposal and treatment of their municipal waste water;
WHEREAS, this Council has previously agreed to enter such an
arrangement and has provided its guidance in Resolutions 130-83 and 143-83;
WHEREAS, the negotiations for a Waste Water Disposal and Treatment
Contract have been completed; and,
WHEREAS, a proposed contract has been submitted for consideration
and approval.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:
Paragraph 2B of Resolution 143-83, as passed and approved by this
Council on August 2, 1983, is repealed and the following paragraph is substituted
therefor:

B. The contract shall provide for the establishment of
a rate to be paid by Lakeside City based upon the cost
of providing the service by the City of Wichita Falls,
such costs to be computed using generally accepted rate
setting techniques and procedures. The rate shall be
based upon the volume of water taken by Lakeside City
under the provisions of a separate Water Purchase Contract
dated April 13, 1970. Furthermore, the rate charged to
Lakeside City shall be not more than one and one-half times
the cost of the service charged to like customers within
the city limits. Such rates are to include capital investments,
if any, as incurred by the City of Wichita Falls in
order to continue and improve the service in the
future."
The Waste Water Disposal and Treatment Contract with Lakeside
City, as submitted and as it may have been changed by the Council, is
approved and the City Manager is authorized to execute the same for the
City of Wichita Falls.
