RESOLUTION APPROVING AND AUTHORIZING THE CITY MANAGER
TO SIGN AN AGREEMENT AND EASEMENT IN EDGEMERE PARK WITH
TEXAS ELECTRIC SERVICE COMPANY.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, THAT :
That certain agreement and easement, a copy of which is attached
hereto, for an undergound service lateral in Edgemere Park with
Texas Electric Service Company is hereby approved, and the City
Manager is authorized to execute the same for the City of Wichita
Falls .
PASSED AND APPROVED this the 3rd day of January, 1984 .

A 3. 29 acre tract of land out of Cherokee County School Land, Block 3,
LOT Abstract 33, dedicated in the Edgemere South Addition, an addition to the
BLOCK City of Wichita Falls,- dedicated in the Plat Records, Volume 641, Page 431,•
ADDITION Wichita County, Texas.

1 1. Texas Electric Service Company agrees to install, own, operate, and maintain the underground
service lateral described above to be used in providing electric service to Customer. •
2. Customer agrees to pay Company the amount specified above in consideration of Company's
installing an underground service lateral for Customer and agrees that Company is entitled to and
will retain for Company's benefit the amount of payment specified above in consideration of
Company's obligation to install and maintain the underground service lateral.
1 3. Company is not liable for loss or injury caused by delay or failure to install said underground
service lateral because of acts of God, inevitable accidents, fires, explosions, riots, wars, or any
other causes reasonably beyond control of Company. If Company is prevented from installing
j said underground service lateral for any reason, Company agrees to return to Customer, without
interest, the entire amount of Customer's payment, thereby terminating this agreement and the
easement granted herein.
I 4. In consideration of Company's agreement to install and maintain said underground service lateral,
Customer hereby grants to Company an easement and right-of-way to install, operate, and maintain
I said underground service lateral from Company's existing line across and under Customer's premises
described above to Customer's service entrance, and Customer agrees that Company may remove,
without compensation to Customer, any trees, shrubs, bushes, fences, or other obstructions that
interfere with the installation or maintenance of said underground service lateral.
5. Customer understands that this agreement is not binding until accepted by Company. If Company
does not accept this agreement within 30 days of the date Customer signs this agreement, the
I agreement and easement granted herein is null and void. Customer clearly understands that
overhead facilities may in the future be constructed adjacent to the above described lot(s) on
property not covered by this agreement.
