AN ORDINANCE CLOSING, VACATING, AND ABANDONING A
TEN (10) FOOT WIDE UTILITY EASEMENT BETWEEN LOTS 26
AND 27, BLOCK 2, MIDWESTERN PARK, UNIT 2.
WHEREAS, the Planning Board of the City of Wichita Falls, Texas
has recommended the abandonment of a ten (10) foot wide utility easement
between Lots 26 & 27, Block 2, Midwestern Park, Unit 2; and,
WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas
deems it advisable and in the public interest to close, vacate, and abandon
the utility easement hereinafter described.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The ten (10) foot wide utility easement lying centered
on the common lot line between Lots 26 and 27, Block 2, Midwestern Park, Unit 2,
be and the same is hereby closed, vacated, and abandoned.
SECTION 2. This ordinance shall become effective upon filing with the
Wichita County Clerk of a replat of a portion of said Lot 26 and all of Lot 27
into one (1) lot, within one (1) year of the date of passage of this ordinance.
PASSED AND APPROVED this the 2nd day of March, 1982.
