ORDINANCE NO. - `
AN ORDINANCE CLOSING, VACATING, AND ABANDONING A TWENTY-
FIVE (25) FOOT WIDE NORTH-SOUTH ALLEY IN BLOCK 2, I.
JALONICK ADDITION, AND RETAINING A UTILITY EASEMENT.
WHEREAS, the Planning Board of the City of Wichita Fall.:, , Texas has
recommended the closure of a twenty-five (25) foot wide north-sou:: alley in
Block 2, I. Jalonick Addition; and,
WHEREAS, the Board of Aldermen of the City of Wichita F;, 1s, Texas
deems it advisable and in the public interest to close, vacate, and abandon
the alley hereinafter described.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1: The twenty-five (25) foot wide north-south alley in
Block 2, I. Jalonick Addition, between the south right-of-way line of 16th
Street and the north right-of-way line of Kell Boulevard, be and the same is
hereby closed, vacated, and abandoned.
SECTION 2: The City of Wichita Falls, Texas hereby reserves on the
entire area described in Section 1, a utility easement for the purposes of
laying and maintaining all kind and character of utility lines including water,
gas, electric, telephone, television cable, power lines, and sanitary and storm
sewers. If such easement is fenced, this ordinance is passed subject to the
right of the City to ingress and egress the retained easement, through a gate
provided for in the north end of the said easement.
SECTION 3: This ordinance shall become effective upon filing with
the Wichita County Clerk a replat of property on both sides of the alley into
one (1) lot, within one (1) year of the date of passage of this ordinance.
