Ord 044-82 4/6/1982 ORDINANCE NO. Lid J � ORDINANCE ESTABLISHING NEW REGULATIONS GOVERNING LOADING AND UNLOADING OF VEHICLES ON CITY STREETS AND REPEALING SECTIONS 29-127 THROUGH 29-136 OF THE CODE OF ORDINANCES. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. Sections 29-127 through 29-136 of the Code of Ordinances as amended are hereby repealed. SECTION 2. The Code of Ordinances of the City of Wichita Falls .is hereby amended by adding new Sections 29-127 through 29-138 to read as follows. "SECTION 29-127 Definitions. For the purpose of this division the following terms or words shall have the meaning herein ascribed to them: A loading zone is defined as a space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers, materials, or merchandise. An alley entrance is defined as a building access that abuts on or has an entrance to a public alley, that provides ingress or egress to a street or other thoroughfare for vehicles used in handling and loading and unloading of material or merchandise. Space as used herein is defined as an area equal to one standard parking space, as determined by the Traffic Engineer based on the type of parking permitted at the parti- cular curb or location. Time limit as used herein is defined as the posted time, assigned by the City Traffic Engineer, to any Loading Zone not to exceed thirty (30) minutes. SECTION 29-128. Permit required for loading or unloading at an angle to the curb. . (a) The city traffic engineer is authorized to issue special permits for loading and unloading merchandise or materials subject to the terms and conditions of such permit. Such permits may be issued either to the owner or lessee of real property or to the owner of the vehicle and shall grant to such person the privilege as therein stated and authorized herein. (b) It shall be unlawful for any permittee or other person to violate any of the special terms or conditions of any such permit. SECTION 29-129. City traffic engineer to designate curb loading zones. -1- Page 2 of 10 Pages Agenda Item No.15c The city traffic engineer is hereby authorized to determine the location of passenger and freight curb loading zones and shall place and maintain appropriate signs indicating the same and stating the hours during which the provisions of this section are applicable. SECTION 29-130. Restriction as to use. No vehicles other than those used in loading and unloading of merchandise and in the transportation thereof shall be parked in any loading zone. SECTION 29-131. Allocation of loading zones. (a) Loading zones shall be allocated by the city traffic engineer. (b) The city traffic engineer shall arrange for the marking of all loading zones provided for under this article. (c) The city traffic engineer shall assign time limits to all loading zones allocated under this section. In no case shall the time limit assigned exceed thirty (30) minutes. SECTION 29-132. Standing in passenger curb loading zones. No person shall stop, stand, or park a vehicle for any purpose or period of time other than for the expeditious loading or unloading of passengers in any place marked as a passenger curb loading zone during hours when the regulations applicable to such curb loading zones are effective, and then only for a period not to exceed three (3) minutes. SECTION 29-133. Standing in freight curb loading zone. No person shall stop, stand, or park a vehicle for any purpose or length of time other than for the expeditious unloading and delivery or pickup and loading of freight from or into a truck engaged in commercial activities in any place marked as a freight curb loading zone during hours when the provisions applicable to such zones are in effect. In no case shall the stop for loading and unloading of freight exceed the posted time limit. SECTION 29-134. Standing in vehicle loading zone. No person shall stop, stand, or park a vehicle for any purpose or length of time other than for the expeditious unloading and delivery or pickup and loading of materials in any place marked as a loading zone during hours when the provisions applicable to such zones are in effect. The city traffic engineer is hereby authorized to determine and establish by posting the time limits for stopping, standing, or parking a vehicle for the purposes herein specified in a vehicle loading zone. In no case shall the stop for loading and unloading of materials exceed the posted time limit. -2- Page 3 of 10 Pages Agenda. Item No.15 c SECTION 29-135. The city traffic engineer to designate public carrier stops and stands. The city traffic engineer is hereby authorized and required to establish bus stops, bus stands, taxicab stands, and stands for other passenger common-carrier motor vehicles on such public streets in such places and in such number as he shall determine to be of the greatest benefit and convenience to the public, and every bus stop, bus stand, taxicab stand, or other stands shall be designated by appropriate signs. SECTION 29-136. Stopping, standing, and parking of buses and taxicabs regulated. (a) The operator of a bus shall not stand or park such vehicles upon any street at any place other than at a bus stand so designated as provided herein. (b) The operator of a bus shall not stop such vehicle upon any street at any place for the purpose of loading or unloading passengers or their baggage other than at a bus stop, bus stand, or passenger loading zone so designated as provided herein, except in case of emergency. (c) The operator of a bus shall enter a bus stop, bus stand, or passenger loading zone on a public street in such a manner that the bus when stopped to load or unload passengers or baggage shall be in a position with the right front wheel of such vehicle not farther than eighteen (18) inches from the curb and the bus approximately parallel to the curb so as not to unduly impede the movement of other vehicular traffic. (d) The operator of a taxicab shall not stand or park such vehicle upon any street at any other place other than in a taxicab stand so designated as provided herein. This provision shall not prevent the operator of a taxicab from temporarily stopping in accor- dance with other stopping or parking regulations at any place for the purpose of and while actually engaged in the expeditious loading or unloading of passengers. SECTION 29-137. Restricted use of bus and taxicab stands. No person shall stop, stand, or park a vehicle other than a bus in a bus stop, or other than a taxicab in a taxicab stand when any such stop or stand has been officially designated and appropriately signed, except that the driver of a passenger vehicle may temporarily stop therein for the purpose of and while actually engaged in loading and • unloading passengers when such stopping does not interfere with any bus or taxicab waiting to enter or about to enter such zone. Every person who shall be convicted of a violation of Sections 29-130, 29-132, 29-133, 29- 134, and 29-137 of the Code of Ordinances shall be punished by a fine of five dollars ($5.00). Each successive period of time, equal to the time limit on the loading zone, that a person allows a vehicle to remain in a loading zone shall constitute a separate offense. Every person who shall be convicted of violations of any of the other provisions of Article V of Chapter 29 of said Code shall be punished by a fine of not more than two hundred dollars 0200.00).
