ORDINANCE CHARGING AN ADDITIONAL PENALTY TO DELINQUENT TAX ACCOUNTS, NOTIFYING ALL PERSONS
HAVING DELINQUENT TAX ACCOUNTS AND DECLARING AN EMERGENCY.
Whereas, the State Property Tax Code in Section 33.07 provides that a city may
charge an additional penalty not to exceed 15% for all ad valorem taxes which become
delinquent July 1 of the current year, specifically to defray the cost of collecting
such taxes, and
Whereas, the State Property Tax Code requires that delinquent property tax owners
be notified of the City's intent to collect, such a fee beginning July 1 ;
NOW THEREFORE, BE IT ORDAINED BY THE CITY OF WICHITA FALLS, TEXAS, THAT:
Section 1 . That taxes remaining delinquent on July 1 , of the year in which
they become delinquent shall incur an additional penalty of 15
percent of the amount of taxes, penalty, and interest due.
Section 2. That a tax lien attaches to the property on which the tax is imposed
to secure payment of the penalty.
Section 3. That the tax collector shall deliver a notice of delinquency, and
of the penalty, to the property owner at least 30 and not more
than 60 days before July 1 , of the year taxes become delinquent.
Section 4. In order to pass the costs of delinquent tax collections onto the
persons who have failed to pay their taxes and due to the short
time in which to notify the delinquent taxpayers, this ordinance
is hereby declared to be an emergency ordinance, and is effective
immediately.
