Ord 067-82 7/6/1982 ORDINANCE NO. 67-82 ORDINANCE REQUIRING NOTIFICATION OF ADJACENT PROPERTY OWNERS OF REQUESTS FOR WAIVERS OF ORDINANCES RESTRICT- ING ISSUANCE OF PERMITS WHICH VIOLATE DEED RESTRICTIONS, AND REQUESTS FOR WAIVERS OF ORDINANCES WHICH AUTHORIZE THE CITY TO FILE SUITS TO ENFORCE DEED RESTRICTIONS. WHEREAS, heretofore the Board of Aldermen has adopted Ordinances No. 3456 , No. 3490 and No. 3648 , which authorize the City to file suits to enforce certain land use restrictions, and Ordinances No. 3457 , No. 3647 and No. 3699 , which restricted the issuance of building permits, building moving permits and curb cut permits which violate deed restrictions; and, WHEREAS, occasionally property owners will request that the Board of Aldermen waive these ordinances when exceptional circumstances exist which make the enforcement of such ordinances unreasonable; and, WHEREAS, when such waivers are to be considered by the Board of Aldermen, it is deemed to be proper that notification of such matters should be given to adjacent property owners. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: Whenever the City receives a request for waiver of one or more of Ordinances No. 3456 , No. 3490, No. 3648, No. 3457 , No. 3647 , and No. 3699, written notice that such request will be considered by the Board of Aldermen shall be sent to owners of real property lying within 300 feet of the property for which the waiver is requested, such notice to be given, not less than 10 days before the Board of Aldermen is to consider such request, to all such owners who have rendered their said property for City taxes as the ownership appears on the last approved City tax roll. Such notice may be served by depositing the same, prop- erly addressed and postage paid, in the City post office. 1 r ; A fee of $50. 00 shall be charged by the City to the person who makes the request for waiver. � ,r (� PASSED AND APPROVED this the .,FL day of 1982 .
