BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. Article I , Section I , Paragraph B is hereby amended and shall hereafter read as follows: Page 3 of 15 pages Agenda Item NO. "The Board of Electrical Examiners shall consist of seven members, who shall serve without compensation, selected as follows: (1) Two (2) Master Electricians. (2) One (1) Journeyman Electrician. . (3) One (1) member who is an employee of the Local Electric Utility Company (currently known as the Texas Electric Service Company) . (4) One (1) member who shall be a representative of industry. (5) One (1) member who shall be a home-builder or otherwise associated with the home-building industry. (6) One (1) member who shall be designated as a member at large. This member shall not be connected with the electrical contracting industry for monetary gain. a. Four members of this Board shall constitute a quorum. b. Any member of the Board involved in a dispute before the Board, shall disqualify himself, and an alternate member shall be selected by the Board to serve in his place. " SECTION 2 . Article I, Section I, Paragraph C is hereby amended, and shall hereafter read as follows: "The existing Board shall serve its regular appointed term after the enactment of this ordinance. Thereafter all Page 4 of 15 pages -2- Agenda. Item No. members shall be appointed for terms of two years each. Any member of the Board may resign from his ap- pointment by submitting a formal resignation to the City Council at a regularly scheduled Council Meeting. " SECTION 3. Article 3 , Section 1, Paragraph B . is hereby amended and shall hereafter read as follows: "Any person, company, firm, partnership or- corp- . oration engaged in the electrical contracting business within the corporate limits of the City of Wichita Falls, Texas, shall be or have continuously in his/her employment a qualified Master Electrician and shall file in the office of the Chief Electrical In- spector the correct name, address and license number of such Master Electrician, which Master Electrician shall be available in person within twenty-four (24) hours from the time the Electrical Inspector first determines that the Master Electrician is needed for consultation either on the job site or in his/her established place of business within the corporate limits of the City of Wichita Falls, Texas, from which place he/she shall have actual supervision over the work being performed and shall be responsible for carrying out the provisions of this chapter in its entirety. Article III, Section II , Paragraph A is hereby amended, and shall hereafter read as follows: "A person desiring a Master Electrician ' s license shall be a citizen of the United States , shall have reached the age of twenty-one (21) years and shall make application in writing to the Board of Electrical Examiners for an examination. Examinations shall be held periodically as determined by the Board at a regularly scheduled Board meeting. An applicant shall be allowed to appear before the Board and request an examination at a time other than as regularly scheduled. Such a request shall be granted if the Board finds that a denial of the request would substantially injure the applicant, and finds that good cause exists for the requested examination. The application shall be presented tp the Secretary of the Board and shall be accompanied by a fee of Fifty Dollars ($50) . " SECTION 5. Article III, Section II , Paragraph C is hereby amended and shall hereafter read as follows: "If the applicant is successful in passing the examination, he shall obtain a bond from an approved surety company doing business in the State of Texas, in the amount of Five Thousand Dollars ($5, 000) payable to the City of Wichita Falls, Texas , and conditioned upon the applican ' t strict and faithful compliance with this ordinance. Said bond must be furnished by Page 6 of 15 pages -4- Agenda Item No. a firm having a representative in the City of Wichita Falls, Texas, which bond shall bear as principal the successful applicant and such surety company and shall be signed by the successful applicant and which bond must be delivered to the City of Wichita Falls, Texas, within thirty (30) days prior to beginning of any work; otherwise, the examination shall be null and void. A successful applicant shall pay to the secretary the sum of Two Hundred Dollars ($200) , as the first year' s license fee. The Two Hundred Dollars ($200) must be paid within thirty (30) days after the grading of the examination paper and prior to the beginning of work; otherwise, the examination shall be null and void. In case of failure to pass the examination, an applicant must wait ninety (90) days before being allowed to take another examination, and a waiting period of six (6) months will be required between the second and third examination and between all subsequent examinations. The waiting periods commence on the date the examination paper is graded. The fee of Twenty-five Dollars ($25) shall be required for each examination. When a Master Electrician has not obtained permits for electrical work within a one (1) year period in the City of Wichita Falls, it will be his responsibility to Page 7 of 15 pages Agenda Item No. -5- prove that he is actively engaged in the electrical business as a Master Electrician in order to obtain a license renewal. If such evidence of activity is found by the Electrical Advisory Board to be lacking, they shall require the applicant to take the applicable examination to show that said applicant is qualified. Qualified applicants who comply with the above provisions shall be issued a license signed by the Secretary and Chairman of the Board of Examiners. The license shall be valid for the remainder of the calendar year. All present and future licenses shall expire each December 31, annually. " SECTION 6. Article III , Section II , paragraph D is hereby amended and shall hereafter read as follows: "The license holder shall have a grace period of thirty (30) days for renewal of such licenses. If license is not renewed by 5: 00 P.M. on January 31, the license holder shall be required to take a new examination, and pay all applicable fees. The license may be renewed by paying to the secretary the sum of One Hundred Dollars ($100) within thirty (30) days after the expiration date of the original license. " SECTION 7. Article 3, Section 3 , Paragraphs A, B, C, E, and F are hereby repealed. Page 8 of 15 pages Agenda Item No. -6- r SECTION 8 . Article III , Section III , Paragraph D is hereby amended, and shall hereafter read as follows: "The license holder shall have a grace period of thirty (30) days for renewal of the Industrial Electrician Licenses. The license may be renewed by paying to the secretary the sum of Twenty-five Dollars ($25) within thirty (30) days after the expiration date of the original license. " SECTION 9. Article III, Section IV, Paragraph A is hereby amended and shall hereafter read as follows: "A person desiring a Journeyman Electrician' s License shall be a citizen of the United States , reach the age of twenty-one (21) years, and shall make application for the issuance of a license to the secretary. Exam- inations shall be held periodically as determined by the Board at a regularly scheduled Board meeting. The application shall be presented to the Secretary of the Board, and shall be accompanied by a fee of Ten Dollars ($10) . " • SECTION 10. Article III , Section IV, Paragraph E is hereby amended and shall hereafter read as follows: "The license may be renewed by paying to the secre- tary the sum of Ten Dollars ($10) not later than the 31st day of each year. If a license is not renewed prior Page 9 of 15 pages Agenda Item No. -7- to the 31st day of January, it shall thereafter be void. " SECTION 11. Article III , Section IV, Paragraph F is hereby amended and shall hereafter read as follows: "A license shall be issued to an individual and shall not be assignable. No person shall engage in the occupation of Journeyman Electrician within the City of Wichita Falls without having his license on his person at all times. No person shall allow the use of his Journeyman Electrician' s License, directly or indirectly, by any other person for the purpose of constructing electrical installations. In addition to the penalty provided in this chapter, any person convicted of violating this provision shall forfeit his license, and it shall there- after be void. / It may be renewed only after a waiting period of one (1) year, and then only after he has successfully passed a Journeyman Electrician ' s examination and has paid the fee of Ten Dollars ($10) for the re- mainder of the calendar year. " SECTION 12 . Article III , Section V, Paragraph A is hereby amended and shall hereafter read as follows: "Apprentices, trainees or helpers shall be super- vised in the presence of a master Electrician, Journeyman Electrician or a Maintenance Electrician at all times. Item No. Nothing shall justify an Apprentice Electrician in per- forming any phase of electrical installations unless a Master Electrician, Journeyman Electrician or Maintenance Electrician is actually present during such installation. " SECTION 13 . Article III , Section VI , Paragraph B %s hereby amended and shall hereafter read as follows: "There shall be a charge of Ten Dollars ($10) for the original registration and Ten Dollars ($10) for each renewal. " SECTION 14 . Article IV, Definitions, is hereby amended to add the definition of "actual supervision" , and shall hereafter read as follows: "Actual supervision shall mean the authority to determine, regulate and specify the methods, procedures, materials, design or construction used in the installation , maintenance or repair of electrical systems, components, materials or devices. " . SECTION 15. Article IV, Definitions, is hereby amended to delete the definition of "Industrial Electrician. " SECTION 16. Article VI, Section IV, Paragraph E is hereby amended and shall hereafter read as follows: "All conduits underground shall be rigid galvanized conduit or approved raceway and EMT shall not be permitted Page 11 of 15 pages Agenda Item No. -9- underground. For light and power, all underground service conduit shall be a minimum size of two (2") inches internal diameter. Installation of underground branch circuit cable (Type UF) shall comply with the provisions of the current addition of the National Electrical Code, as specifically . approved. Underground branch circuit cable may be used, in- cluding direct burial in the earth, as branch circuit cable when provided with overcurrent protection not in excess of the rated current carrying capacity of the individual conductors. Single conductor cable shall not be installed under any circumstance. The conductor, Type UF cable, with one conductor grounded securely to all metal portions of the circuit, may be buried directly in the earth, at the minimum depth of eighteen inches (18") . This type cable is approved solely for use in residential areas , and for residential home use, and is to be exclusively restricted to the outside installation of area lighting and general purpose receptacles. This approval is not to be construed to allow the connection of motors or similar type permanent electrical installations. This type cable shall not be used (1) as service entrance cable, (2) in commercial garages , (3) in theaters , (4) in motion pictures studios, (5) in storage battery Page 12 of 15 pages Agenda Item No. -10- rooms, (6) in hoistways, (7) in hazardous locations , (8) imbedded in poured cement, concrete or aggregate, nor (9) in air void in masonry block or tile walls, nor (10) in shallow chases in masonry, concrete or plaster walls, nor (11) in similar types of concealment. Direct burial cable, when not installed in race- ways, shall be installed in pre-inspected trenches at a minimum depth of eighteen inches (18" ) below the finished grade. If the trench bottom is not of a smooth, even soil, it shall be covered with a two inch (2") soil fill to protect the cable against sharp objects.. The cable shall be protected, at the point of entry and exit of the trench, by rigid metal conduit extending to a minimum depth of twelve inches (12") below the surface of the finished grade. " SECTION 17 . Article VII, Section V is hereby amended and shall hereafter read as follows: "Permits may be granted for temporary services to any licensed Master Electrician for a predetermined and limited time by application for a temporary permit and the payment of proper inspection fee. The application shall state time required for temporary service. Temporary service installations shall generally conform to Attached Drawing No. 1. Any Page 13 of 15 pages Agenda Item No. -11- • temporary service installation that does not fully conform to code specifications shall not be approved by the Electrical Inspector. Inspection fees shall be the same as for a standard installation. The Electrical Inspector may cause the electric supply company to disconnect any temporary service promptly . on the expiration date of each temporary permit after proper written notification. " SECTION 18 . Article VIII, Section II , is hereby amended and shall hereafter read as follows: "When any electrical work covered by this ordinance is reported to the Electrical Inspector as ready for final inspection, and upon such inspection, the electrical work does not meet all requirements of this ordinance, the permit electrician shall be notified by telephone and tag of the1defects existing, and he shall correct such defects promptly, and request a reinspection to the Electrical Inspector; and the permit holder shall pay an additional fee of Ten Dollars ($10) for each reinspection required before final approval is given. If for reason of faulty work, negligence or omission, changes or additions are required by the inspector or if an incorrect address is given on the permit necessitating an additional trip by the inspector, a reinspection permit must be taken out, and a charge of Ten Dollars ($10) will be made for each extra trip. Page 14 of 15 pages -12- Agenda Item No. This rule shall not apply where periodic inspection is required during progress of construction. " SECTION 19. Article VIII , Section IV, Paragraph E, under the heading "outlets" is hereby amended and shall • • hereafter read as follows: "New construction residential outlets, each $1. 00 per 100 square feet with a minimum fee of Ten Dollars ($10) per residence. " SECTION 20. Article VIII , Section IV, Paragraph. E, under the heading of "heaters" is hereby amended and . shall hereafter read as follows: "Dryers (electrically heated) , each. . . $100 Water, each 1 00 Bathroom, each 50 Space or supplementary resistance. 0-5 K. W. , each 2 00 5-10 K. W. , each 3 00 10 K. W. and up, each 4 00.
