RESOLUTION AUTHORIZING THE PUBLICATION OF NOTICE
OF INTENTION TO LEASE FOR OIL AND GAS CERTAIN
LANDS LOCATED IN WICHITA COUNTY AND AT LAKE
KICKAPOO IN ARCHER COUNTY, TEXAS .
WHEREAS, the City of Wichita Falls has received a request that
certain land owned by the City in Wichita County near Kadane Corner,
and a request that certain land owned by the City in Archer County
near Lake Kickapoo, be leased for oil and gas exploration and
production.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS , TEXAS , THAT:
SECTION 1 . It is advisable, under proper circumstances, to
lease for the development of oil and gas those two certain tracts
of land, one located in Wichita County, Texas , and one in Archer
County, Texas, which tracts are described by metes and bounds on
Exhibit A, which is attached hereto .
SECTION 2 . Any such oil and gas leases shall provide for at
least 3/16 royalty, and shall have primary terms for no more than
two (2) years .
SECTION 3 . Any such oil and gas leases shall be executed on
the City 's standard oil and gas lease form.
SECTION 4 . As the second tract is located adjacent to Lake
Kickapoo, no actual drilling may occur on the property covered by
such lease unless the location of each well is approved in advance
by the City, and the methods used in drilling and producing such
well meet all the specifications to be required by the City for
protecting the water in the lake .
SECTION 5 . Each tract shall be bid on separately, and a
bidder need not bid on both tracts . A bid on a portion of a
tract will not be considered .
SECTION 6 . City shall give notice of intention to lease
such lands by publication once a week for three (3) consecutive weeks
t.
in a newspaper published in the county in which the land is located,
which notice shall describe the land and designate the time and
place at which the City Council will receive and consider bids for
such leases .
SECTION 7 . City will not warrant the title to the minerals
in such lands . The City apparently owns all the minerals .
SECTION 8 . The City Council will reserve the right to
reject any and all bids, and give notice and call for additional
bids, if same is determined to be in the best interest of the City.

FIRST TRACT :
Two and one-half (2-1/2) acres of land out of the William
H . Spillers Survey, Abstract No. 258 , Patent No . 499 , Volume 17,
Certificate 290 , in Wichita County, Texas , described as follows :
BEGINNING in the west boundary line of
the said Spillers Survey 5 , 731 feet north
of its southwest corner in the north line
of a public road;
THENCE north along the west boundary line
of said survey 363 feet, a stake;

imately 500 feet north and 275 feet west
of the southeast corner of the B . H . Mordecia
Survey No . 5, A-290 ;
THENCE north 70 ° east 1, 915 feet along a
fence separating the City of Wichita Falls
property and the Cowan & McKinney property
to a fence corner located in the S . A. &
M. G. Survey No . 177 , A-447 ;
THENCE north 1, 100 feet along a fence
separating the City of Wichita Falls property
and the Cowan & McKinney property;
THENCE south 70 ° west 1, 915 feet for a
