RESOLUTION ACCEPTING CONSTRUCTION AND AUTHORIZING
FINAL PAYMENT TO THE CONTRACTOR FOR COMPLETION OF
THE 1985 PAVEMENT OVERLAY PROGRAM
WHEREAS, the City of Wichita Falls and Zack Burkett Construction
Company entered into a contract dated September 24, 1985, for the construction
of the 1985 Pavement Overlay Program.
WHEREAS, such project has been completed in accordance with the
plans and specifications; and,
WHEREAS, such contract was a unit price contract and the estimated
cost based on estimated quantities was $431,460.00; however, $290,761.42 has
been paid to its contractor, leaving a balance due of $139,660.30. This
project was accepted November 6, 1985.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:
The construction of such project is accepted by the City of Wichita
Falls, and the City Manager is authorized and directed to pay to the contractor
the amount due as set out above.
