RESOLUTION ACCEPTING CONSTRUCTION AND AUTHORIZING
FINAL PAYMENT TO THE CONTRACTOR FOR 38TH STREET
PROJECT 84-2 COMMUNITY DEVELOPMENT STREET CONSTRUCTION
PROGRAM
WHEREAS, the City of Wichita Falls and Zack Burkett Company of Wichita
Falls entered into a contract dated May 15, 1984, for the construction of the 38th
Street Project 84-2 Community Development Street Construction Program; and,
WHEREAS, such project has been completed in accordance with the plans and
specifications; and,
WHEREAS, such contract was a unit price contract, and the estimated cost
based on estimated quantities was $315,919.79; however, on the basis of the actual
quantities used in the construction, the total contract price is $312,268.11 of which
280,890.01 has been paid to the contractor, leaving a balance due of $31,378.10.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
The construction of such project is accepted by the City of Wichita Falls,
and the City Manager is authorized and directed to pay to the contractor the amount
due as set out above.
