RESOLUTION APPROVING SETTLEMENT OF
CONDEMNATION CASE WITH BURLINGTON NORTHERN
RAILROAD CONCERNING TRANSFER STATION SITE.
WHEREAS, the City heretofore filed a condemnation suit
against Fort Worth and Denver Railway (now Burlington Northern) ,
to acquire the site for the transfer station. The Special
Commissioners entered an award of $207,000 to be paid to the
railroad for the site; and,
WHEREAS, the railroad appealed the case to District Court,
and a tentative compromise has been made on the case; and,
WHEREAS, the City Council finds that such compromise is in
the best interest of the City and should be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The City Manager is hereby authorized to execute a
compromise agreement with the Burlington Northern Railroad of
this case, whereby the City shall pay to Burlington Northern an
additional $40,000; with respect to drainage ditches on property
owned by the Railroad adjoining the condemned property, no ditch
lining will be required at this time and the necessity for such
lining will depend upon the future development of the property in
accordance with applicable statutes or ordinances.
