RESOLUTION ACCEPTING CONSTRUCTION AND AUTHORIZING
FINAL PAYMENT TO THE CONTRACTOR FOR THE EASTSIDE
DRIVE MEDIAN IRRIGATION AND LANDSCAPING PROJECT
WHEREAS, the City of Wichita Falls and J. Foster Landscaping
of Wichita Falls, Texas entered into a contract dated June 26, 1985, for the
construction of the Eastside Drive Median Irrigation and Landscaping Project;
and,
WHEREAS, such project has been completed in accordance with
the plans and specifications; and,
WHEREAS, such contract was a unit price contract, and the
estimated cost based on estimated quantities was $48,321.90; however,
34,993.53 has been paid to the contractor, leaving a balance due of
13,328.37.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The construction of such project is accepted by the City of
Wichita Falls, and the City Manager is authorized and directed to pay
to the contractor the amount due as set out above.
