RESOLUTION ACCEPTING CONSTRUCTION AND AUTHORIZING
FINAL PAYMENT TO THE CONTRACTOR FOR JAYCEE PARK -
ROAD AND PARKING LOT IMPROVEMENTS
WHEREAS, the City of Wichita Falls and McGrath Brothers Concrete
entered into a contract dated June 19, 1984, for the Jaycee Park - Road and
Parking Lot Improvements; and,
WHEREAS, such project has been completed in accordance with the
plans and specification; and,
WHEREAS, such contract was a unit price contract and the estimated
cost based on estimated quantities was $256,715.75; however, $220,926.81 has
been paid to its contractor, leaving a balance due of $35,788.94 of which
22,953.15 was withheld until some of the concrete was removed and replaced.
This has been completed as of June 7, 1985.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:
The construction of such project is accepted by the City of Wichita
Falls, and the City Manager is authorized and directed to pay to the contractor
the amount due as set out above.
