RESOLUTION NO. (1A-V)
RESOLUTION APPROVING APPRAISALS OF PROPERTY FOR
BARNETT RD . RECONSTRUCTION AND AUTHORIZING PUR-
CHASE OR CONDEMNATION.
WHEREAS, it is necessary to acquire the hereinafter described
property for the reconstruction of Barnett Road from Farm to Market
Road 369 to U. S. 277 in the City of Wichita Falls; and,
WHEREAS , such property has been appraised by an independent
appraiser employed by the City of Wichita Falls, and the amount of
the property value, as determined by the appraiser, has been
studied by the City Council, and copies are now in the possession
of the City' s Property Administrator.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The legal descriptions of the right-of-way parcels
and easements to be purchased are as follows (right-of-way parcels
to be acquired in fee simple) :

SECTION 2 . The authorized price to be paid for each parcel
is the value as determined from the appraisal made by the real
estate appraiser employed by the City of Wichita Falls . The value
of each parcel is hereby approved and the City Manager is authorized
to purchase each parcel described above in the name of the City of
Wichita Falls .
SECTION 3 . In the event the City Manager is unable to pur-
chase such parcels for the appraised value, he is authorized to
increase the offer, when in his judgment it appears to be in the
best interest of the City to do so to save the cost of condemnation.
If both parties are unable to agree on a value for the property,
the City Manager is hereby authorized and directed to cause to
be instituted condemnation proceedings to obtain such property in
the name of the City of Wichita Falls .
