Res 058-85 5/7/1985RESOLUTION NO. 6g RESOLUTION AGREEING WITH AND ENDORSING THE CITY MANAGER'S ADMINISTRATIVE POLICY REFERENCE NO. 28 , ESTABLISHING A RESIDENCY POLICY FOR ALL CITY EMPLOYEES. WHEREAS , the City Manager has established by Administrative Policy Reference No. 28 a residency policy for all City employees; a copy of such policy is attached hereto. NOW, THEREFORE , BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS , TEXAS, THAT: The City Council hereby goes on record agreeing with and endorsing such residency policy so established by the City Manager PASSED AND APPROVED this the 7th day of May, 1985 . Y 0 R ATTEST: Ci y Clerk CITY OF WICHITA FALLS, TEXAS ADMINISTRATIVE POLICIES EFFECTIVE DATE: POLICY REFERENCE NO. 28 PAGE 1 OF TO: Department Directors and Division Heads FROM:James Berzina, City Manager SUBJECT: Residency Policy I 1. 0 PURPOSE AND POLICY Residents of the City of Wichita Falls will be given a prefer- I ence when applying for employment with the City of WichitaFalls. A similar preference will be given to residents who are already employed and who are competing for non-Civil Service promotion to a higher position within the City's service. The intent of this policy is to insure that: 1.1 Local taxpayers and their dependents are given first 1 opportunity for employment by the City, a public agency which is supported by their tax dollars; 1.2 Wages paid by the City remain within the local economy; 1.3 Employees will be committed to the welfare of the jcommunity. 2. 0 DEFINITIONS 2.1 Residence: The true, fixed and permanent home of the employee or the applicant for employment, to which, when- ever he is absent, he has the intention of returning. Article 5. 08 of the Texas Election Code shall comprise the rules for determining residence. 2. 2 Corporate Limits: The formal boundaries of the City of I Wichita Falls as adopted by the City Council of the CityofWichitaFalls. 2. 3 Applicant: Any individual applying for a position of employment with the City of Wichita Falls. 2. 4 Employee: Any individual holding a position of employ- ment with the City of Wichita Falls. 2.5 Probationary Period Employee: An employee who has not I completed the six month probationary period or an exten- sion thereof following an initial appointment to employ- ment or reappointment following a break in service. 2. 6 City Manager: The City Manager or designee. PAGE 2 OF 2. 7 Management Personnel: City Manager, Assistant City Manager, Department Directors, and Division Heads. 1 2.8 Personnel Officer: The Personnel Officer or designee. il 3. 0 GENERAL PROVISIONS 3.1 Applicants: All qualified applicants will be considered for employment regardless of city of residence when 1 qualifications are equal. Applicants who live inside the corporate limits of the City of Wichita Falls will be given preference over those living outside the city 14 limits when appointments to the City are being made. 3.2 All new employees hired as of May 1, 1985, who currently live outside the city limits must move within the corporate l limits of the City of Wichita Falls by the ending date of their probationary period. 1 3. 3 Individuals: All individuals employed by the City of Wichita Falls prior to May 1, 1985, and who maintain a continuous employment relationship with the City, will be exempted from the residency requirements of this policy as they relate to their current position. Such employees will, however, be covered by this policy as it relates to promotions within City employment. 1 4. 0 PROCEDURES 1 4. 1 Prior to the appointment of an applicant to a position of employment, the applicant must certify in writing to the Personnel Officer that his address and residence is within the corporate limits of the City of Wichita Falls. For1purposesofthispolicy, the address given on the appli- cation for employment will constitute such confirmation and certification. Applicants who reside outside the city limits may be appointed to a position of employment only upon certification by the applicant that the appli- cant will, prior to the final date of his probationary I period of employment, establish residence within the corporate boundaries of the City of Wichita Falls. The Personnel Officer shall establish a form which non- resident applicants must complete which will certify the1applicant' s agreement to relocate within the corporate boundaries of the city. J 4. 2 Any employee hired on or after May 1, 1985, and who subsequently establishes residence outside the corporate limits of the City of Wichita Falls, will be terminated REVISION NO. Any non-resident employee hired prior to May 1, 1985, and who is a resident of the City of Wichita Falls as of May 1, 1985, or becomes a resident of the City of Wichita Falls on or after May 1, 1985, will also be terminated should he establish a new residence outside the city limits of the City of Wichita Falls. I4.3 Any employee changing residence or address must notify the Personnel Office of such change of address within 30 days of the date of such change. Failure to report a change of residence or address may result in discipli- nary action against the employee. 4. 4 Any employee whose telephone number is a long distance number will be responsible for the cost of all calls originated by said employee (e.g. , employee calls in sick) . 5. 0 EXCEPTIONS 5.1 The City Manager may authorize an exception to this policy in instances where, after a reasonable effort has been made, qualified applicants for a specific position cannot be found who are either residents of the City of Wichita Falls or certified that they will be willing to become residents during their probationary period. In such instances, the City Manager may authorize the Personnel Officer to exempt that poisiton from the residency requirement. 6. 0 REVISION AND QUESTIONS 6.1 Questions regarding this policy shall be addressed to the Personnel Division. 6.2 The Personnel Officer is responsible for review and recommending revisions of this policy prior to May 1 of each successive year.
