RESOLUTION ACCEPTING CONSTRUCTION AND AUTHORIZING
FINAL PAYMENT TO THE CONTRACTOR FOR 1984 STREET
SURFACE OVERLAY PROGRAM
WHEREAS, the City of Wichita Falls and Zack Burkett Company
entered into a contract dated October 2, 1984, for the Street Surface
Overlay Program; and,
WHEREAS, such project has been completed in accordance with
the plans and specifications; and,
WHEREAS, such contract was a unit price contract and the estimated
cost based on estimated quantities was $312,740.00; however, on the basis of
its actual quantities used in the construction. The total contract price is
285,753.17, of which $264,267.70 has been paid to its contractor, leaving a
balance due of $21,485.47.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:
The construction of such project is accepted by the City of Wichita
Falls, and the City Manager is authorized and directed to pay to the contractor
the amount due as set out above.
PASSED AND APPROVED THIS 2ND DAY OF APRIL, 1985.
