ORDINANCE GRANTING AUTHORITY TO H.P.R. PARTNERSHIP
TO _CONSTRUCT A CARD READER CONTROL ON THE ELEVENTH
STREET RIGHT-OF-WAY.
WHEREAS, H.P.R. Partnership is renovating an existing building at 1101 Scott
Street, and this building has a. vehicle ramp leading from Eleventh Street to the second
floor parking area.. H.P.R. Partnership desires to control access to this parking by
means of a card key system, and to locate the card reader upon the right-of-way of
Eleventh Street.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
"Section 1. H.P.R. Partnership is hereby granted the right and authority to construct
such card reader control on the street right-of-way on Eleventh Street as shown on plan
dated September 27, 1982 by Harper Perkins Architects.
Section 2. H.P.R. Partnership shall coordinate such project with all utility
companies and City facilities that are located in the Eleventh Street right-of-way.
Section 3. It shall be the responsibility of H.P.R. Partnership'. at all times to
maintain said card reader control devices at its own expense. If at any time in the
future some public use of such right-of-way makes it necessary that such device be
relocated or removed, such relocation or removal shall be done at the sole cost and
expense of H.P.R. Partnership.
Section 4. Whenever any work is being done on the construction or maintenance
of such device, H.P. R. Partnership shall take all necessary and proper precautions
to protect the public from damages. H.P.R. Partnership shall hold and save the City
of Wichita. Falls harmless from all damages or claims for damages resulting from the
construction, maintenance and location of such device.
Section 5. The right and authority hereby granted is for so long as said devices
are used and maintained by H.P.R. Partnership. When such devices are no longer so
used, and when and if requested by the City of Wichita. Falls, H.P.R. Partnership shall
remove such devices and restore right-of-way to original condition at its sole cost and
expense.
