Ord 117-82 12/7/1982 ORDINANCE NO. //7 e ORDINANCE WAIVING ORDINANCES CONCERNING CITY ENFORCE- MENT OF DEED RESTRICTIONS FOR THE FOLLOWING PROPERTIES IN FAITH VILLAGE, UNIT III: LOTS 1-8 , BLOCK 73 AND LOTS 1-4 , BLOCK 74 . WHEREAS, a request has been made that the City waive those ordinances concerning City enforcement of deed restrictions for the hereinafter named properties located in Faith Village, Unit III; and, WHEREAS, the Board of Aldermen find that the circumstances in- volved in this situation are exceptional, and that a waiver of such ordinances should be granted only in the event that the development and uses of such property shall be restricted as hereinafter set out. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: Ordinances No. 3456, No. 3490, No. 3648, No. 3457, No. 3647 and No. 3699, all of which relate to the enforcement by the City of deed restrictions, are hereby waived insofar as they affect Lots 1-8, Block 73 and Lots 1-4 , Block 74, Faith Village, Unit III, an addition to the City of Wichita Falls, Texas, provided that the owners of such properties shall subject such properties to the following restrictions: 1 . No building exceeding one story shall be constructed on the property. 2 . All outside lighting on the property shall be directed toward Kemp Boulevard. / / 3 . All signs shall be on the Kemp Street side of the property, and shall be specifically addressed in the site plan. 4 . Public parking area for the property shall be between the buildings and Kemp Boulevard. No vehicular access to the subject property shall be allowed from Wolfe Street. 5 . A site plan for any and all phases of development shall be provided the City Planning Department, together with a fee of $25. 00. The Planning Department shall forward such site plan to the Board of Aldermen, who shall hold a public hearing concerning such plan. The Planning Department shall give notice by mail of the public hearing to the owners of all properties located within 300 feet of the properties covered by this ordinance. If such site plan is approved by the Board of Aldermen, it shall be considered a part of this ordinance, and the property shall be developed in accordance with such approved plan. 6 . The initial phase of development on each block shall be accompanied by a curb cut plan for the entire block, which curb cuts shall be located so as not to create hazardous traffic conditions. The curb cut plan should indicate a twenty-five foot driveway ease- ment, running North-South, providing access to all the lots . 7 . The only occupancy of the property allowable will be professional offices, financial institutions and retail outlets as provided for in the approved site plan stipulated under paragraph 5 above. No food or liquor services, or establishments having out- side sound equipment or producing offensive odors will be allowed. 7 8 . Any development, improvements or building modifications shall comply, at a minimum, with the basic criteria contained in this ordinance. 9 . If development of these properties is undertaken on a phase basis, each phase shall be compatibly designed and laid out. PASSED AND APPROVED this the 7.4a/ day of / G1,,z- t,,/ 1982 .
