Ord 018-83 2/15/1983 ORDINANCE NO. ///--L' ORDINANCE AMENDING SECTION 17-58 , SUBSECTION (a) TO REQUIRE A LICENSE TO TRANSPORT GARBAGE OR TRASH TO TRANSFER STATION, AMENDING SECTION 17-62 , SUBSECTION (b) TO INCREASE LANDFILL USE FEES AND SET TRANSFER STATION USE FEES AND ADDING SECTION 17-66 TO PROHIBIT THE USE OF CERTAIN CONTAINERS AND TRAILERS ON TRANSFER STATION TIPPING FLOOR. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1 . Section 17-58 , Subsection (a) of the Code of Ordinances of the City of Wichita Falls is hereby amended to read as follows : " (a) Required . No person, except duly authorized agents and employees of the City, shall empty garbage cans or trash receptacles into or convey or trasnport garbage or trash to any landfills owned or maintained by the City, without a written license for each vehicle used for such purpose granted and issued by the Department of Public Works and without having paid the required fee as herein prescribed . A separate license shall also be required for each vehicle transporting garbage or trash to any solid waste transfer station owned or maintained by the City . " SECTION 2 . Section 17-62, Subsection (b) of the Code of Ordinances of the City of Wichita Falls is hereby amended to read as follows : " (b) Landfill and Transfer Station Use Fees . Fees for the use of the landfill shall be at the rate of six dollars ($6 .00) per ton for garbage and trash originating from within the City limits and twelve dollars ($12 .00) per ton from outside the City limits . Fees for the use of the transfer station shall be at the rate of ten dollars ($10 .00) per ton for solid waste originating from within the City and twenty dollars ($20 .00) per ton for solid waste from outside the City limits . Weights shall be determined to the nearest one-quarter (1/4) ton and charged accordingly . The minimum charge shall be equal to the rate for one-quarter (1/4) ton. Fees for each type license and use are as follows . (1) Refuse from a Wichita Falls residence which is assessed the residential rate may be disposed of at the landfill or transfer station without charge . If rental property is involved, or if the hauler is being compensated for the hauling, a disposal fee shall be assessed. The Sanitation Superintendent or Disposal Site Supervisor shall havethe authority to determine if a fee is to be assessed in situations not otherwise covered by City ordinance . a (2) Class 1: Six dollars ($6 .00) per ton for refuse hauled to the landfill, ten dollars ($10 .00) per ton for refuse hauled to the transfer station. At either site there will be a minimum charge equal to the applicable rate for one-quarter (1/4) ton . All charges will be accumulated on a monthly basis with the monthly total billed subtracting the ten dollar and seventy five cents ($10 .75) minimum rate for commercial establish- ments . No monthly rate will be reduced below minimum fee and all charges in excess of the minimum fee will be added to the monthly utility bill . (3) Class 2: Six dollars ($6 .00) per ton for refuse hauled to the landfill, ten dollars ($10 .00) per ton for refuse hauled to the transfer station. At either site there will be a minimum charge equal to the applicable rate for one-quarter (1/4) ton . Charges will be accumulated on a monthly basis and added to the monthly utility bill . (4) Class 3 : Twelve dollars ($12 .00) per ton for refuse hauled to the landfill and twenty dollars ($20 .00) per ton for refuse hauled to the transfer station. There will be a minimum charge equal to the applicable rate for one-quarter (1/4) ton. Fee shall be paid upon entrance to Disposal Site by cash, coupon, or pre-arranged charge account. (5) Class 4 : Rate to be determined by origination of refuse . Refuse hauled from inside the City limits will be charged six dollars ($6 . 00) per ton at the landfill or ten dollars ($10 .00) per ton at the transfer station. Refuse hauled from outside the City limits will be charged twelve dollars ($12 .00) per ton at the landfill or twenty dollars ($20 .00) per ton at the transfer station. There will be a minimum charge equal to the applicable rate for one-quarter (1/4) ton. Payment shall be made by the method arranged upon issuance of license . (6) Class 5 : Rate to be determined by origination of refuse. Refuse hauled from inside the City limits will be charged six dollars ($6 .00) per ton at the landfill or ten dollars ($10 .00) per ton at the transfer station . Refuse hauled from outside the City limits will be charged twelve dollars ($12 .00) per ton at the landfill or twenty dollars ($20 .00) per ton at the transfer station. There will be a minimum charge equal to the applicable rate for one-quarter (1/4) ton . Payment shall be made by method arranged upon issuance of license. " SECTION 3 . Section 17-66 , which is hereby adopted, shall read as follows : "Sec . 17-66 . Transfer Station Exceptions . All private haulers and contract haulers of solid waste, who are properly licensed by the City, shall have access to the transfer station tipping floor with the following exceptions: (a) No detachable container with a volume in excess of twelve (12) cubic yards shall be emptied from the transfer station tipping floor. (b) Trailers exceeding twenty (20) feet in length will not be parked on or driven across the tipping floor. " PASSED AND APPROVED this the ��` /day of February, 1983 .
