AN ORDINANCE CLOSING, VACATING, AND ABANDONING A TEN (10) FOOT
WIDE UTILITY EASEMENT IN LOT 3, BLOCK 2, ARNOLD HEIGHTS, AN
ADDITION TO THE CITY OF WICHITA FALLS, TEXAS
WHEREAS, the Planning Board of the City of Wichita Falls, Texas has
recommended the abandonment of the ten (10) foot wide utility easement in Lot 3,
Block 2, Arnold Heights; and,
WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas deems
it advisable and in the public interest to close, vacate, and abandon the utility
easement hereinafter described.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:
SECTION 1. The north-south ten (10) foot wide and two hundred (200)
foot long utility easement in Lot 3, Block 2, Arnold Heights, an addition to the
City of Wichita Falls, Texas, and lying adjacent to the eastern boundary of said
Lot 3 between the south right-of-way line of P.B. Lane and the southern boundary
of said Lot 3, be and the same is hereby closed, vacated, and abandoned.
SECTION 2. This ordinance shall become effective upon the filing with
the Wichita County Clerk of a replat of Lot 3, Block 2, Arnold Heights and a
portion of Block 2, McKenzie Subdivision into one (1) lot, within one (1) year
from the date of passage of this ordinance.
