AN ORDINANCE CLOSING, VACATING, AND ABANDONING A
TWENTY (20) FOOT WIDE, UNPAVED, NORTH-SOUTH ALLEY
IN THE LITTEKEN ADDITION, WICHITA FALLS, TEXAS,
AND RETAINING A UTILITY EASEMENT AND MAKING PRO-
VISIONS FOR VEHICULAR ACCESS IF FENCED
WHEREAS, the Planning Board of the City of Wichita Falls, Texas
has recommended closing the twenty (20) foot wide, unpaved, north-south
alley in the Litteken Addition; and,
WHEREAS, the City Council of Wichita Falls, Texas deems it
advisable and in the public interest to close, vacate, and abandon the
alley hereinafter described.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF WICHITA
FALLS, TEXAS, THAT:
SECTION 1: The twenty (20) foot wide, unpaved, north-south alley
lying between Lot 14, Litteken Subdivision and the south one-half (Z) of
Lot 3 and all of Lot 4, Block 46A, Highland Addition, on the east, and Lot 13,
Litteken Subdivision, on the west, and extending from the northern right-of-
way line of Kenesaw Avenue northward for a distance of one hundred two and
one-half (102.5) feet to the southerly right-of-way line of a fifteen (15)
foot wide, east-west alley in said Block 46A, Highland Addition, all being
in Wichita Falls, Texas; be and the same is hereby closed, vacated, and
abandoned.
SECTION 2: The City of Wichita Falls hereby reserves on the entire
area described in Section 1, a utility easement for the purposes of laying and
maintaining all kind and character of utility lines including water, gas,
electric, telephone, television cable, power lines, and sanitary and storm
sewers.
SECTION 3. If the utility easement described in Section 2 is ever
to be fenced, provisions for vehicular access must be made as required by the
Director of Public Utilities.
