Ord 067-83 6/7/1983 ORDINANCE NO. 67-83 AN ORDINANCE EXTENDING THE CITY LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, BY ANNEXING A CERTAIN TRACT OF LAND ADJACENT TO THE TERRITORIAL LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, WHICH TRACT OF LAND AND SERVICE PLAN FOR SUCH TRACT OF LAND IS DESCRIBED IN THIS ORDINANCE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS THAT: SECTION 1. TRACT DESCRIPTION. The following tract of land located in Wichita County, Texas, be and the same is hereby ordered to be annexed and to be included within the corporate limits of the City of Wichita Falls, Texas, and the corporate limits be extended so as to include said tract of land in Wichita County, Texas, the same being more particularly described as follows : A TRACT OF LAND out of Block 11, Denton County School Land, League 2, Wichita County, Texas, and being more specifically described by metes and bounds as follows : BEGINNING at a 1/2" iron rod in a curve of the South right-of-way line of Southwest Parkway (F.M. Highway No. 369) , a dedicated street, said right-of-way line also being the present city limits line of Wichita Falls, Texas, as described in Ordinance No. 1910, said 1/2" iron rod bears North 89° 45' West 1420.7 feet and South 76.57 feet from the Northwest corner of Blk 11, Denton County School Land, League 2, and also being the Northeast corner of a certain 0.18 acre tract of land out of said Block 11, conveyed to Constance D. Smith from Tony Anthony, as recorded in Volume 865, Page 21, Wichita County Deed Records, for the most Northerly Northwest corner and place of beginning of this descrip- tion, the bearing of the tangent to the curve at said 2" iron rod bears North 77 38' 50" West; THENCE in an Easterly direction along said South right-of-way line and along a 2.909 degree curve to the left, having a radius of 1969.86 feet and a central angle of 10° 10' 10", a distance of 349.63 feet to a 1/2" iron rod for a point of tangency; THENCE South 87° 49' East 307.53 feet along said South right-of-way line to a 1/2" iron rod for the Northeast corner of this tract; THENCE leaving said South right-of-way line, South 02° 23' 50" West 370.00 feet to a 1/2" iron rod for the most Easterly Southeast corner of this tract; THENCE North 87° 49' West 138.62 feet to a 1/2" iron rod for an interior corner of this tract; THENCE South 02° 11' West 45.00 feet to a 1/2" iron rod for the most Southerly Southeast corner of this tract; THENCE North 87° 49' West 200.00 feet to a 1/2" iron rod for corner; -2- THENCE North 02° 11' East 5.00 feet to a 1/2" iron rod for an interior corner of this tract; THENCE North 87° 49' West 380.80 feet to a 1/2" iron rod for the South- west corner of this tract; THENCE North 01° 11' 28" East 339.75 feet to a 1/2" iron rod for the most Westerly Northwest corner of this tract and the Southwest corner of said 0.18 Acre tract; THENCE South 88° 48' 32" East 73.10 feet to a 1/2" iron rod for an interior corner of this tract and the Southeast corner of said 0.18 acre tract; THENCE North 01° 11' 28" East 100.00 feet to the place of beginning and containing 6.67 acres, more or less. SECTION 2. SERVICE PLAN. This Service Plan for annexation of property to the City of Wichita Falls has been prepared by the Planning Department of the City of Wichita Falls in conformance with the requirements of Article 970a, Section 10, Vernon's Texas Civil Statutes. SECTION 2.1. Services to be provided within sixty (60) days. A. Police Protection. Police protection will be provided by the Wichita Falls Police Department within sixty (60) days of the effective date of annexation, using existing personnel and equipment. B. Fire Protection. Fire protection will be provided by the Wichita Falls Fire Department within sixty (60) days of the effective date of annexation, using existing personnel and equipment. Primary service will be provided by Fire Station No. 6, which has a response time of 2.0 minutes. Back-up will be provided by Station No. 8, with a response of 4.5 minutes. C. Solid Waste Collection. Solid waste collection shall be provided by the City of Wichita Falls Sanitation Division in accordance with Chapter 17, Garbage, Refuse, Rubbish and Trash, Code of Ordinances, City of Wichita Falls, within sixty (60) days of the effective date of annexation. D. Maintenance of Water and Waste Water Facilities. Maintenance of water and waste water facilities shall be the responsibility of the developer for a period of one (1) year following the acceptance of said facilities by the City. Following the one (1) year period of obligation of the developer, the City of Wichita Falls Public Utilities Department shall assume all responsibility for maintenance of water and waste water facilities from thence forward, in accordance with Chapter 32, Water and Sewers, Code of Ordinances, City of Wichita Falls. -3- . E. Maintenance of Roads, Streets, and Alleys. Maintenance of roads, streets, and alleys shall be the responsibility of the developer for a period of two (2) years following the acceptance of said facilities by the City. Following the two (2) year period of obligation of the developer, the City of Wichita Falls Public Works Department shall assume all responsibility for maintenance of the roads, streets, and alleys from thence forward, in accordance with Chapter 27, Streets and Sidewalks, Code of Ordinances, City of Wichita Falls. SECTION 2.2. Capital Improvements. All capital improvements including streets, alleys, water service lines and waste water service lines shall be con- structed by the developer in accordance with Comprehensive Subdivision Ordinance No. 2118. SECTION 3. PUBLIC HEARINGS. In conformity with Section 6 of Article 970a of the Revised Civil Statutes of Texas, before these annexation proceedings were instituted, the City Council called public hearings on April 19 and April 25 , 1983, to provide an opportunity for all interested persons to be heard; notice of such hearings were published once each in the Wichita Falls Record News not more than twenty (20) days nor less than ten (10) days prior to each public hearing. Such public hearings were held on April 19 and April 25- , 1983, which were not more than forty (40) days nor less than twenty (20) days prior to the institution of these annexation proceedings. SECTION 4. INTRODUCTION OF ORDINANCE. In conformity with Section 3-A of the amended Charter of the City of Wichita Falls, Texas, this ordinance is on the 17th day of May, 1983, introduced and the City Clerk is directed to publish said ordinance one (1) time in a newspaper of general circulation published in the City of Wichita Falls, Texas, and seven (7) days thereafter this ordinance may be finally acted upon. This ordinance having been introduced on the 17th day of May, 1983 and having been published in a newspaper of general circulation in the City of Wichita Falls, Texas, to wit, the Wichita Falls Record News, one (1) time, on the 23rd day of May, 1983 and seven (7) days after such publication having elapsed, this ordinance is finally passed and approved this the 7th day of June, 1983. SECTION 5. EMERGENCY PROVISION. Because of the fact that building is taking place in this area which will require city services as soon as possible, this ordinance is declared to be an emergency measure, and it will become effective • . -4- upon its passage.
