AN ORDINANCE CLOSING, VACATING, AND ABANDONING THE
TWENTY-FIVE (25) FOOT WIDE, UNPAVED, EAST-WEST AND
NORTH-SOUTH ALLEYS IN BLOCK 241, BEAN AND STONE
RESURVEY OF BLOCKS 240 AND 241, ORIGINAL TOWNSITE
OF WICHITA FALLS, TEXAS, AND RETAINING A UTILITY
EASEMENT IN THE EAST-WEST ALLEY
WHEREAS, the Planning Board of the City of Wichita Falls, Texas has
recommended closing the twenty-five (25) foot wide, unpaved, east-west and
north-south alleys in Block 241, Bean and Stone Resurvey; and,
WHEREAS, the City Council of Wichita Falls, Texas deems it advisable
and in the public interest to close, vacate, and abandon the alleys hereinafter
described.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF WICHITA FALLS,
TEXAS, THAT:
SECTION 1: The twenty-five (25) foot wide, unpaved, north-south alley
in Block 241, Bean and Stone Resurvey of Blocks 240 and 241, Original Townsite
of Wichita Falls, Texas, said alley lying between Lots 5 and 6, Block 241, Bean
and Stone Resurvey, and being bounded on the north by the south right-of-way line
of Third Street and being bounded on the south by the north right-of-way line of
the twenty-five (25) foot east-west alley in Block 241, Bean and Stone Resurvey;
be and the same is hereby closed, vacated, and abandoned.
SECTION 2: The twenty-five (25) foot- wide, unpaved, east-west alley
in Block 241, Bean and Stone Resurvey of Blocks 240 and 241, Original Townsite
of Wichita Falls, Texas, said alley being bounded on the east by the west right-
of-way line of Bluff Street, on the west by the east right-of-way line of Broad
Street, on the south by the north boundary line of Lot 1A, Block 240A, Bean and
Stone Resurvey, and on the north by the south boundaries of Lots 1-10, Block 241,
Bean and Stone Resurvey and the south boundary of the north-south alley described
in Section 1; be and the same is hereby closed, vacated, and abandoned.
SECTION 3: The City of Wichita Falls hereby reserves on the entire area
described in Section 2, a utility easement for the purpose of laying and maintaining
all kind and character of utility lines including water, gas, electric, telephone,
television cable, power lines, and sanitary and storm sewers.
