Ord 078-83 6/21/1983 ORDINANCE NO. 78-83 ORDINANCE GRANTING WAIVER OF SECTIONS 8-2 AND 27-5 OF THE CODE OF ORDINANCES ON JUNE 25, 1983 FOR THE SIDEWALK SALE IN DOWNTOWN WICHITA FALLS . WHEREAS, the Downtown Association of Wichita Falls has requested permission to have a sidewalk sale in the downtown area on Saturday, June 25 , 1983, between the hours of 8 : 00 o 'clock a .m. and 5: 00 o'clock p.m. , which sale has been an annual affair in the summer; and, WHEREAS, Section 8-2 of the Code of Ordinances restricts advertising and selling of goods on any public street or sidewalk within the fire limits, and Section 27-5 prohibits the storing of goods, wares , and merchandise on streets and sidewalks without the consent of the City Council . NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: The provisions of said Section 8-2 and Section 27-5 of the Code of Ordinances are hereby waived for the purpose of allowing the sidewalk sale in the downtown area on Saturday, June 25, 1983, between the hours of 8 : 00 o 'clock a .m. and 5: 00 o'clock p.m. ; provided, however, that the Downtown Association and the participating merchants shall take every precaution to make sure that the sidewalk is safe for pedestrians, and shall not allow merchandise to be placed on the sidewalk in such a manner that it constitutes a hazard; further, the Downtown Association of Wichita Falls and the participating merchants in the sidewalk sale shall indemnify the City from all liability for damages arising out of the use of the sidewalk and streets for the display and sale of merchandise. The Downtown Association shall purchase liability insurance to cover the sale, and present evidence of such insurance to the City Attorney. PASSED AND APPROVED this the 21st day of June, 1983 .
