RESOLUTION AUTHORIZING THE PURCHASE OF APPROX-
IMATELY 6 ,500 ACRES OF LAND FOR THE RINGGOLD
RESERVOIR FROM H. MACON BODDY AND OTHERS.
WHEREAS, the City of Wichita Falls anticipates the con-
struction, operation and maintenance of a dam facility across
the Little Wichita River in Clay County, Texas, approximately
ten (10) miles northwest of Ringgold, Texas, which is necessary
for the impounding of water for the City; and,
WHEREAS, the City staff and City Attorney have pursued
a negotiated purchase in lieu of eminent domain of approximately
6,500 acres of land up to 844 . 2 mean sea level at fair market
value, which land is necessary for the construction, operation
and maintenance of this project from H. Macon Boddy, Macon
Clark Boddy, and Labotex; and,
WHEREAS, H. Macon Boddy, Macon Clark Boddy and Labotex
have agreed to sell to the City of Wichita Falls the above-
referenced property at the fair market value and upon the terms
and conditions previously negotiated.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF WICHITA FALLS, TEXAS, THAT:
The Mayor of the City of Wichita Falls , Texas is hereby
authorized, empowered and directed to execute and deliver for
the City of Wichita Falls such consideration and documents
as are necessary to accomplish the purchase of approximately
6 ,500 acres of land necessary for the Ringgold Dam and Reservoir
from H. Macon Boddy, Macon Clark Boddy and Labotex, and to
perform such acts and deeds and to execute and deliver in the
name and under the official seal and on behalf of the City
of Wichita Falls all such instruments, whether or not herein
mentioned, as may be necessary or desirable in order to carry
out the terms and provisions of this resolution.
