Res 172-86 11/4/1986RESOLUTION NO. /U- %6 RESOLUTION APPROVING THE APPRAISAL OF PARCELS 8 , #10 , AND #11 FOR THE HOLLIDAY CREEK CHANNEL IMPROVEMENT PROJECT, SETTING JUST COMPENSATION, AND AUTHORIZING PURCHASE OR CONDEMNATION. WHEREAS, it is necessary to acquire drainage easements on Parcels #8, #10, and #11 for the excavation of Holliday Creek; and, WHEREAS, such property has been appraised by Henderson Appraisal, an independent appraiser employed by the City of Wichita Falls, and the appraisals have been reviewed by the Property Administrator and are now on file in the Property Management Office. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. It is necessary that the City of Wichita Falls acquire drainage easements on the hereinafter described property for the purpose of constructing the Holliday Creek Channel Improve- ment Project. SECTION 2 . The legal descriptions of the drainage easements located in Wichita Falls, Wichita County, Texas, to be acquired are as follows: Parcel #8 A 0 . 95 acre tract out of the John A. Scott Survey II, Abstract 299, as fully described by metes and bounds in a field survey prepared by Corlett, Probst & Boyd, Inc. , in August, 1986 . Parcel #10 A 0. 26 acre tract out of Block 8 of Barwise and Jalonick Addition, as fully described by metes and bounds in a field survey prepared by Corlett, Probst & Boyd, Inc. , in August, 1986. Parcel #11 A 0 . 033 acre tract out of Block 8 of Barwise and Jalonick Addition, as fully described by metes and bounds in a field survey prepared by Corlett, Probst & Boyd, Inc. , in August, 1986. SECTION 3. The amount of just compensation is to be set at $8, 266 . 00 for Parcel #8; $906. 00 for Parcel #10; and $115. 00 for Parcel #11, which is also the fair market value determined by a real estate appraiser employed by the City of Wichita Falls. The City Manager is hereby authorized to acquire drainage ease- ments on Parcels #8, #10, and #11, as described above, in the name of the City of Wichita Falls. SECTION 4 . In the event that the City Manager is unable to purchase such parcels for the appraised value, he is authorized to increase the offer when, in his judgment, it appears to be in the best interest of the City to do so to save the cost of condemnation. If both parties are unable to agree upon a value for the property, the City Manager is hereby authorized and directed to cause to be instituted condemnation proceedings to obtain such property in the name of the City of Wichita Falls for the Holliday Creek Channel Improvement Project.
