Res 154-86 10/7/1986is t RESOLUTION NO. 154-86 RESOLUTION ESTABLISHING POLICY ON OUTSIDE AGENCY FUNDING BY CITY OF WICHITA FALLS. WHEREAS, the City Council receives numerous requests by various agencies for funds, and the Council desires to establish a formal policy on the method for submittal and review of outside agency funding requests, and to set a maximum limit on the total funding for outside agencies which serve public purposes. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: There is hereby adopted the following policy on funding by the City of outside agencies: SECTION 1. Agency funding requests will be reviewed annually by a committee of the City Council to determine the justification for and level of funding for the next fiscal year. Requests must be submitted to the Assistant City Manager' s Office by May 15 for consideration for the fiscal year beginning the following October 1. SECTION 2. General Fund. A. Outside agencies will be considered for funding from the General Fund on an ongoing basis only if the City of Wichita Falls was actively involved in the founding of that agency. These agencies include Martin Luther King Center, Community Action Corporation of the Wichita Falls and North Texas Area, and Wichita Falls Community Mental Health Mental Retardation Center. Requests from other agencies which serve public purposes will be considered, but on a one-time basis only. Preferential consideration will be given to funding requests for special projects or emergency needs other than for support of the agency' s general operating budget. B. Available funding will be dependent on estimated General Fund revenues for that fiscal year. Total General Fund funding for outside agencies shall not exceed one percent (1%) of the General Fund budget for any fiscal year. SECTION 3. Community Development Block Grant Funds. A. Agencies providing services which benefit low or moderate income areas or low or moderate income individuals may request funding from the Community Development Block Grant funds allo- cated to the City of Wichita Falls. B. Available funding for agencies will be dependent on the amount of Community Development Block Grant funds allotted to the City of Wichita Falls. In addition, no more than fifteen percent (15%) of the funds allotted to the City may be used to provide social services. SECTION 4. Hotel/Motel Fund. A. Outside agencies may request funding from the six percent 6%) Hotel/Motel Occupancy Tax for the following purposes: 1) The acquisition of sites for and the construction, improvement, enlarging, equipping, repairing, operation, and 2 - maintenance of convention center facilities including, but not limited to, civic center convention buildings, auditoriums, coliseums, civic theaters, museums, and parking areas or facilities for the parking or storage of motor vehicles or other conveyances located at or in the immediate vicinity of the convention center facilities. 2) The furnishing of facilities, personnel and materials for the registration of convention delegates or registrants. 3) For advertising for general promotional and tourist advertising of the City and its vicinity and conducting a solici- tation and operating program to attract conventions and visitors either by the City or through contracts with persons or organiza- tions selected by the City. 4) The encouragement, promotion, improvement and appli- cation of the arts including music (instrumental and vocal) , dance, drama, folk art, creative writing, architecture, design and allied fields, painting, sculpture, photography, graphic and craft arts, motion pictures, television, radio, tape and sound recording, and the arts related to the presentation, per- formance, execution, and exhibition of these major art forms. 5) Historical preservation and restoration projects or activities at or in the immediate vicinity of convention center facilities or historical preservation and restoration projects or activities located elsewhere in the City that would be frequented by tourists and visitors to the City. 3- y B. Available funding for agency requests will be dependent on the estimated revenue from the Hotel/Motel Occupancy Tax for that fiscal year. In addition, use of the funds appropriated from the Hotel/Motel Fund must not exceed the following limitations for use of the revenue from the Hotel/Motel Occupancy Tax. 1) No more than one percent (1%) of the consideration paid by an occupant of the sleeping room to the hotel/motel may be used for the arts. 2) At least one percent (1%) of the consideration paid by an occupant of the sleeping room to the hotel/motel shall be used for advertising and solicitation to attract conventions and tourists and promotional and tourist advertising of the City. 3) At least two percent (2%) of the consideration paid by an occupant of the sleeping room to the hotel/motel shall be used for acquisition, operation, maintenance, etc. , of convention center facilities, and parking areas in the immediate vicinity of such facilities; furnishing facilities, personnel and materials for the registration of convention delegates or registrants; or advertising and solicitation to attract conventions and tourists and promotional and tourist advertising of the City. 4) Revenues derived by the Hotel/Motel Occupancy Tax are to be expended in a manner directly enhancing and promoting tourism and the convention and hotel industry. 4- L PASSED AND APPROVED this the 7th day of October, 1986.
