RESOLUTION TO APPROVE EXECUTION OF PIPELINE LICENSE
FOR WATER PIPELINE
WHEREAS, the City of Wichita Falls intends to install a major
water transmission line from the Cypress Street Water Treatment Plant to the
vicinity of the North Central Expressway intersection with Reilly Road;
WHEREAS, this project will require several crossings of railroads,
each crossing requiring a pipeline license from the rail company; and,
WHEREAS, the Council has considered a pipeline license with the
Missouri-Kansas-Texas Railroad Company for a crossing of a 16" water pipeline
at Mile Post -B-5.94, near the intersection of North Central Expressway and
Reilly Road.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:
The pipeline license is approved except for those portions of
Article II Paragraph 3 which cause the City to be liable for negligence of
the rail company. The City Manager is authorized to execute the pipeline
license with the exceptions noted.
