Res 099-86 7/15/1986RESOLUTION NO. RESOLUTION APPROVING THE APPRAISAL OF 30 UTILITY EASEMENTS FOR THE CYPRESS-REILLY ROAD WATER LINE, SETTING JUST COMPENSATION, AND AUTHORIZING PURCHASE OR CONDEMNATION. WHEREAS , Biggs & Mathews, Inc . , has completed the surveying and engineering work on the Cypress-Reilly Road water line; and, WHEREAS, it is necessary to acquire 30 utility easements for the construction of this 24-inch distribution line; and, WHEREAS, such property has been appraised by an independent appraiser employed by the City of Wichita Falls, and the appraisals have been reviewed by the Property Administrator and are now on file in the Property Management Office . NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS , THAT: SECTION 1 . It is necessary that the City of Wichita Falls acquire the hereinafter described property for utility easements for the purpose of constructing a 24-inch water line from the Cypress Street Water Plant to Reilly Road in order to improve the water distribution system. SECTION 2 . The legal descriptions of the property, located in Wichita County, Texas, are as follows : Parcel #201 A 1 .57 acre tract of land out of Block 8 , League 1, Denton County School Land, and being part of a tract recorded in Volume 354 , Page 618 of the Wichita County Deed Records, and being more specifically described by metes and bounds in a field survey prepared by Biggs & Mathews, Inc . , on May 9 , 1986 . In the event that the City Manager is unable to purchase utility easements on the thirty parcels described above for the appraised value , he is authorized to increase the offer when, in his judgment, it appears to be in the best interest of the City to do so to save the cost of condemnation. If both parties are unable to agree upon a value for the property, the City Manager is hereby authorized and directed to cause to be instituted condemna- tion proceedings to obtain said property in the name of the City of Wichita Falls for the Cypress-Reilly Road Water Line . 7 — PASSED AND APPROVED this the 15th day of July, 1986 .
