RESOLUTION APPROVING THE APPRAISAL OF PROPERTY FOR
THE TWO TANK SITES ON THE CYPRESS-REILLY ROAD WATER-
LINE , SETTING JUST COMPENSATION, AND AUTHORIZING
PURCHASE OR CONDEMNATION.
WHEREAS , Biggs & Mathews, Inc. , has completed the surveying
and engineering work on the Cypress-Reilly Road waterline; and,
WHEREAS , it has been determined that the City of Wichita Falls
must now acquire a 1 .41 acre tract south of U.S . 287 Expressway west
of City View Drive and a 1 .27 acre tract on Reilly Road west of City
View Drive to be used as the sites for the one-million gallon elevated
tank sites on this project; and,
WHEREAS, the proposed tank sites have now been appraised by an
independent appraiser employed by the City of Wichita Falls, and
the appraisals have been reviewed by the Property Administrator
and are now on file in the Property Management Office .
NOW, THEREFORE , BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS , TEXAS , THAT:
SECTION 1. The legal descriptions of the property to be
acquired in fee simple title are as follows :
Parcel #217-A
A 1 .41 acre tract of land out of the G. W. Scott
Survey No. 12 , Abstract 254 , and being part of a
257 .7 acre tract of land recorded in Volume 284 ,
Page 591 of the Wichita County Deed Records , and
being more specifically described by metes and
bounds in a field survey prepared by Biggs &
Mathews, Inc . , on May 14 , 1986 .
Parcel #232-A
A 1 . 27 acre tract of land out of the N. Dembriski
Survey, Abstract 66 , and being part of a 168 acre
tract of land recorded in Volume 952 , Page 386 of
the Wichita County Deed Records , and being more
specifically described by metes and bounds in a
field survey prepared by Biggs & Mathews, Inc . , on
May 15 , 1986 .
SECTION 2 . The amount of just compensation is to be set at
7 , 050 .00 for Parcel #217-A and at $3 ,810 .00 for Parcel #232-A, which
is also the fair market value determined by a real estate appraiser
employed by the City of Wichita Falls . The City Manager is hereby
authorized to acquire fee simple title to Parcel #217-A and #232-A,
as described above, in the name of the City of Wichita Falls .
SECTION 3 . In the event that the City Manager is unable to
purchase such parcels for the appraised value, he is authorized to
increase the offer when, in his judgment, it appears to be in the
best interest of the City to do so to save the cost of condemnation.
If both parties are unable to agree upon a value for the property,
the City Manager is hereby authorized and directed to cause to be
instituted condemnation proceedings to obtain such property in the
name of the City of Wichita Falls for the Cypress-Reilly Road
Waterline Project.
