Res 079-86 6/3/1986RESOLUTION NO. 7,t & RESOLUTION APPROVING THE APPRAISAL OF PARCELS 68 , #73, #74 , #74-A, #75 , #75-A, #75-A-A, #76 , AND #76-A FOR THE HOLLIDAY CREEK CHANNEL IMPROVEMENT PROJECT, SETTING JUST COMPENSATION, AND AUTHORIZING PURCHASE OR CONDEMNATION. WHEREAS , it is necessary to acquire fee simple title to the hereinafter described property known as Parcel #68 , and drainage easements on Parcels #73, #74 , #74-A, #75 , #75-A, #75-A-A, #76 , and #76-A, for the excavation of Holliday Creek; and, WHEREAS, such property has been appraised by an independent appraiser employed by the City of Wichita Falls, and the appraisals have been reviewed by the Property Administrator and are now on file in the Property Management Office . NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS , TEXAS, THAT: SECTION 1 . The legal descriptions of the property to be acquired are as follows : Parcel #68 (Fee Simple Title) A 0 .17 acre tract of land in Block 1, Irrigation Sub- division of John A. Scott Survey 9 , Abstract 305, as fully described by metes and bound in a field survey prepared by Brannon Engineering, Inc . , on January 13 , 1986 . Parcel #73 (Drainage Easement) A 1 .44 acre tract of land in Block 1, Irrigation Sub- division of the North one-half of John A. Scott Survey 7 , Abstract 295 , as fully described by metes and bounds in a field survey prepared by Brannon Engineering, Inc. , on February 24 , 1986 . Parcel #74 (Drainage Easement) A 0 .44 acre tract of land in Block 1 , Irrigation Sub- division of the North one-half of John A. Scott Survey 7 , Abstract 295 , as fully described by metes and bounds in a field survey prepared by Brannon Engineering, Inc . , on February 24 , 1986 . Parcel #76 (Drainage Easement) A 0 .774 acre tract of land in land in Blocks 1 and 8 , Irrigation Subdivision of the North one-half of John A. Parcel #76-A (Drainage Easement) A 0 .351 acre tract of land in Block 1, Irrigation Subdivision of the North one-half of John A. Scott Survey 7 , Abstract 295, as fully described by metes and bounds in a field survey prepared by Brannon Engineering, Inc . , on February 24 , 1986 . 2 - SECTION 2 . The amount of just compensation is to be set as follows : Parcel #68 750 .00 Parcel #75-A 920 .00 Parcel #73 11, 326 .00 Parcel #75-A-A 2 ,160 .00 Parcel #74 3,830 .00 Parcel #76 4 , 370 .00 Parcel #74-A 280 .00 Parcel #76-A 6 ,120 .00 Parcel #75 1 ,098 .00 The above-stated amounts of just compensation are also the fair market values determined by a real estate appraiser employed by the City of Wichita Falls . The City Manager is hereby authorized to acquire fee simple title to Parcel #68 , and a drainage easement on Parcels #73, #74 , #74-A, #75, #75-A, #75-A-A, #76 , and #76-A, as described above, in the name of the City of Wichita Falls . SECTION 3 . In the event that the City Manager is unable to purchase such parcels for the appraised value, he is authorized to increase the offer when, in his judgment, it appears to be in the best interest of the City to do so to save the cost of condemnation. If both parties are unable to agree upon a value for the property, the City Manager is hereby authorized and directed to cause to be instituted condemnation proceedings to obtain such property in the name of the City of Wichita Falls for the Holliday Creek Channel Improvement Project.
