RESOLUTION APPROVING THE APPRAISAL OF PARCELS #64 ,
65 , #66 , AND #67 FOR THE HOLLIDAY CREEK CHANNEL
IMPROVEMENT PROJECT, SETTING JUST COMPENSATION, AND
AUTHORIZING PURCHASE OR CONDEMNATION.
WHEREAS, it is necessary to acquire fee simple title to
Parcels #64 , #66 , and #67 , and a drainage easement on Parcel #65
for the excavation of Holliday Creek; and,
WHEREAS , such property has been appraised by an independent
appraiser employed by the City of Wichita Falls, and the appraisals
have been reviewed by the Property Administrator and are now on file
in the Property Management Office .
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1 . The legal descriptions of the property to be
acquired are as follows :
Parcel #64 (Fee Simple Title)
All of Lots 1 and 2 , Block 9 , Country Club Addition.
Parcel #65 (Drainage Easement)
A 0 .05 acre tract of land in Lot 3, Block 9 , Country
Club Addition, as fully described by metes and bounds in a field
survey prepared by Brannon Engineering on January 13, 1986 .
Parcel #66 (Fee Simple Title)
All of Lot 9 , Block 9 , Country Club Addition.
Parcel #67 (Fee Simple Title)
All of Lot 11 , Block 9 , Country Club Addition.
SECTION 2 . The amount of just compensation is to be set as
follows :
Parcel #64 1, 440 .00 Parcel # 66 750 .00
Parcel #65 170 .00 Parcel #67 690 .00
The above-stated amounts of just compensation are also the
fair market value determined by a real estate appraiser employed
by the City of Wichita Falls . The City Manager is hereby authorized
to acquire fee simple title to Parcels #64 , #66 , and #67 , and a
drainage easement on Parcel #65 , as described above, in the name of
the City of Wichita Falls .
SECTION 3 . In the event that the City Manager is unable to
purchase such parcels for the appraised value, he is authorized to
increase the offer when, in his judgment, it appears to be in the
best interest of the City to do so to save the cost of condemnation.
If both parties are unable to agree upon a value for the property,
the City Manager is hereby authorized and directed to cause to be
instituted condemnation proceedings to obtain such property in the
name of the City of Wichita Falls for the Holliday Creek Channel
Improvement Project.
